WHEREAS, the CITY will be making the following construction improve-
ments located in Salina, Kansas hereinafter called the PROJECT:
REHABILITATION OF THE OAKDALE BRIDGE LOCATED NORTHWEST OF THE
BICENTENNIAL BUILDING; to include complete new superstructure with
two sidewalks and salvage of concrete piling.
Bridge Size - 44'-0" Roadway x 137'-6" Length.
Replace Bridge Approaches - Replace with concrete, L = t60 Ft.

Now, therefore, the parties hereto do mutually agree as follows:
1. The CONSULTANT shall furnish technical and engineering services as required
for complete plans and specifications for the PROJECT
as defined above.
2. The services performed by the CONSULTANT will
include, but not necessarily
be limited to, the following as indicated thusly

3. The proposed PROJECT contemplates design and construction to minimum design
standards as follows:
Bridge Design Loading HS -20 , and Minimum Design Speed
of 30 MPH as may be approved by the Secretary of Transporta-
tion of the State of Kansas, hereinafter referred to as the STATE.
4. The CONSULTANT will prepare and furnish the CITY detailed construction plans
for the PROJECT and perform all required work incidental thereto in a manner ac-
ceptable to the CITY and STATE.
S. The CONSULTANT will prepare revised plans, as requested by the CITY, made
necessary by errors, omissions or negligence of the CONSULTANT, at any time prior
to the completion of the construction as covered by the PROJECT.
6. The CONSULTANT will:
a) Prepare and furnish one set of prints (white background) of prelimi-
nary construction plans for field check and review to the CITY and three (3)
sets to the STATE. These plans may include the following sheets: Title, Typical
Section, Plan -Profile, Cross Sections, Contour Map, Bridge Layout, plus such
other Special Details as the CONSULTANT deems necessary.
b) Furnish two (2) complete sets of prints (white background) to the
STATE for office check. A similar set of prints to be furnished to the CITY.
c) Furnish the STATE with one set of prints (white background) of the
tracings for a final check. A similar set of prints shall be furnished to
the CITY.
d) Furnish the CITY with complete originals for the PROJECT, including
all design calculations, tracings, drawings and specifications as approved by
the STATE.
e) Furnish the CITY with estimates of the PROJECT's cost at the time
of field check, office check, and final plans submitted to the STATE.
7. The CONSULTANT will have available for review by the CITY, STATE and
Federal Highway Administration's personnel, all plans being prepared and
supporting information at the CONSULTANT's office.

8. The CONSULTANT will complete the final plans covered by this proposal with-
in 180 calendar days after approval of the Field Check and notification to
proceed with final design, exclusive of reviews or delays beyond the control of
the CONSULTANT.
9. The CONSULTANT will save the CITY and STATE harmless from all damages to
persons or property caused by him, his agents, employees or sub -contractors which
may result from their operation in connection with the work.
10. The CONSULTANT will prepare and furnish the CITY with supplemental specifi-
cations covering all special fabrication or construction features not covered by
the standard specifications of the STATE.
11. The CONSULTANT will check all shop details and drawings for falsework as may
be required for the project as indicated in the scope of services.
12. The CONSULTANT will make all documents and accounting records pertaining to
the cost of the project available at his office to representatives of the STATE,
Federal Highway Administration or any authorized representative of the Federal
Government.
13. The CONSULTANT will comply with all Federal, State, City and local laws and
ordinances applicable to the work.
14. Remuneration to the CONSULTANT for performgnce of services is as follows:

15. The CONSULTANT will provide engineering services outside those set forth above
or for changes in plans due to changes in criteria at the hourly rates.

All work performed by the CONSULTANT following approval of location and design
criteria which results in a loss to the CONSULTANT by reason of basic changes in
location or geometrics shall be paid for as additional work on the basis of actual
costs incurred by the CONSULTANT to revise the plans to an equal state of
completion as obtained prior to receiving notice of required changes.
16. The CITY will review and approve the CONSULTANT's preliminary location and/or
layouts prior to detail progress of the work.
17. The CITY will make payment within thirty (30) days of receipt of proper
billing for engineering services performed in accordance with an approved progress
schedule. One hundred percent (100%) of the total fee less five percent (5%)
retained will be paid the CONSULTANT within thirty (30) days after final plans have
been filed with the CITY and/or STATE.
18. The CITY will make final payment upon proper billing within one (1) year after
filing of final plans.
19. The CITY will:
a) Furnish benchmark datum control for the PROJECT.
b) Furnish corners for Center -line PROJECT control.

c) Provide legal property descriptions for proposed right-of-way
acquisition.
d) Provide geological borings and other soils data.
e) Provide all information to the CONSULTANT such as maps, drainage areas,
high water data, previous plans, diary data, and other information
needed for correct and efficient design of the PROJECT.
20. The CITY shall have the right to terminate this CONTRACT anytime, upon
written notice, in the event the PROJECT is to be abandoned or indefinitely
postponed, or because of the CONSULTANT's inability to proceed with the work, or
because the services of the CONSULTANT are unsatisfactory, or at the option of the
CITY at the completion of any of the phases; provided, however, that in any case
the CONSULTANT shall be paid a reasonable value of the services rendered up to the
time of termination on the basis of the provisions of this CONTRACT, but in no case
shall payment be more than the CONSULTANT's actual costs plus a reasonable sum for
fixed fee for,profit.
21. It is further agreed this CONTRACT and all Agreements entered into under the
provisions of this CONTRACT shall be binding upon the Parties hereto and their
successors and assigns.
IN WITNESS THEREOF, THE CITY and the CONSULTANT have executed this CONTRACT as
of the date first written above.

Resolution No. 88- 4038, authorizing the execution of an agreement for professional
engineering services between the City of Salina and Mid -Continent Engineers, Salina,
Kansas, to prepare detailed construction plans for the rehabilitation of the Oakdale
Bridge. The scope of the work to be performed by Mid -Continent Engineers is outlined
in the attached proposal.
As a result'of extensive inspection (core drilling, chemical analysis, etc.) of this
structure, the tests indicated the bridge deck, abutments, etc. are highly contaminated
with chlorides. Chlorides have caused delamination of the concrete and also caused
corrosion of the reinforcing steel.
This rehabilitation project involves the removal and replacement of the bridge deck,
abutments, approach slabs, sidewalks, etc. Only the bridge piling will be salvaged.
This structure will remain a span bridge.
The Kansas Department of Transportation has determined this bridge rehabilitation
project is eligible for Federal Funding (80% Federal and 20% Local). This project
is tentatively programmed by KDOT for a construction letting in late 1992.
The design phase of this project is included in the 1988 budget (Capital Improvements).
As stated in the. attached proposal, the engineering fee for the design phase of the
rehabilitation of Oakdale Bridge is $21,400. This fee exceeds the budgeted amount
($10,300) due to the decision to reconstruct this bridge as a span bridge and not as
a'box culvert structure.
