SUBJECT: Maintenance agreement with Kansas Department of Transportation
for City Connecting Links.
I have discussed this agreement with Mr. Bob Anderson of the Kansas
Department of Transportation and John, Director of Services.
John and I both feel it would be advantageous for the Mayor to sign
this agreement and let the Kansas Department of Transportation perform
the maintenance operations on these connecting links.

SPECIAL AGREEMENT FOR MAINTENANCE OF CITY CONNECTING LINKS
This agreement is made between the Secretary of Transportation of the State of Kansas, hereinafter referred to as
Secretary, and the City of Salina , Kansas, hereinafter referred to as City.
The parties hereto mutually agree as follows:
1. In lieu of payment pursuant to K.S.A. 68-416, 68-1902 and amendments thereto, the Secretary agrees to
maintain the following described controlled—access facilities designated as city connecting links in the.state highway system:

2. Maintenance by the Secretary shall be limited to that part of the freeway within the fenced portion of the
right of way or within the access control lines where no fence exists. Such maintenance obligation shall not include the
maintenance of rearranged, relocated, or reconstructed portions of the local street system made necessary by and con—
structed in conjunction with the facility, regardless of whether such portions of the local street system be inside or
outside of the access control lines.
3. Maintenance by the Secretary shall include:
a. Surface and shoulder, including interchange ramps.
b. Structures carrying connecting link traffic including structures on interchange ramps.
C. Below the bottom plane of the deck floor on structures carrying traffic over the facility on local
streets.
d. Deck drainage system to ground elevation where facility is on elevated structure.
e. Mowing, erosion control work, landscaping, fences and drainage systems except where facility is
on elevated structure.
I. Snow removal and ice control.
g. Maintenance of traffic regulatory, informational and warning signs.
h. Those items listed on Attachment A, attached hereto and made a part of this agreement.
4. Responsibility for maintenance of the lighting systems, or any portion thereof, shall be as listed on Attach—
ments A and B of this agreement.
S. The City agrees:
a. To maintain the right of way, frontage roads and access streets constructed in connection with the
connecting link and lying outside of the fenced portion of the right of way or outside of the access
control lines where no fence exists. To maintain all other portions of the local street system re—
arranged, relocated or reconstructed made necessary by and constructed in conjunction with the
facility and lying inside or outside of the access control lines.
b. To maintain all structures carrying traffic over the connecting link on local streets above the bottom
plane of the deck floor and approaches thereto.
C. To maintain all local streets carrying traffic under the connecting link including local streets through
interchange areas.
d. To maintain traffic signal equipment located at the intersection of interchange ramp termini with
focal trafficways.
e. To maintain the area beneath the structure where the facility is on elevated structure.
L To make street cleaning and maintenance equipment, with operators, available from time to time
when available and requested by the Secretary and at rates per hour to be determined by agreement
between the parties.
g. To maintain those items listed on Attachment B, attached hereto and made a part of this agreement.
6. Maintenance under this agreement does not include major bridge repair for which the Secretary and the
City may enter into a separate agreement. Major bridge repair shall mean: -
a. Major Deck Repair d. Pier Repair
b. Girder Repair e. Bridge Painting
C. Abutment Repair
7. ' This agreement shall be in addition to any City Connecting Link Maintenance Agreement entered into by
and between the parties and shall supercede and terminate any previously existing agreement between the parties for
the maintenance of city connecting links covered by this agreement.
8. This agreement may be terminated by either party thirty days after written notice of the intention to
terminate is given to the other party, or by execution of a subsequent Special Agreement for Maintenance of City
Connecting Links.

9. This agreement may be amended or modified only by written agreement of the parties.
10. By entering into this agreement, the Secretary does not waive or alter his rights granted by any statute or
agreement with the City to approve the installation of traffic control devices, entrances and parking lanes, or any other
right granted by statute or agreement concerning the city connecting links covered by this agreement.
11. The__thrjfte_ __map(s) attached hereto as numbered attachment(s), showing the maintenance respon—
sibilities of the parties, is(are) hereby fully incorporated in and made a part of this agreement.
This agreement will become effective on the 91 ct day of
March 1979

R E C I T A L S:
WHEREAS, The Secretary and the said City are empowered by K.S.A.
Chapter 68, Section 169 and Section 412 to enter into agreements for
the maintenance and reconstruction of city connecting links of the
State Highway System through said City, and
WHEREAS, the Secretary and the said City desire to enter into an
agreement for a project of major repair and/or partial reconstruction
of the above designated bridges, and
WHEREAS, said project is a part of a city connecting link of the
State Highway System, and
WHEREAS, the Secretary and the said City have in the past entered
Into an agreement covering routine maintenance of said city connecting
link and it is the intention of the Secretary and the said -City that
said agreement for routine maintenance shall remain in full force and
effect and the mileage set out thereon be not affected by this agree-
ment, and
WHEREAS, the Secretary and the said City desire that the following
maintenance work be done to the existing bridges:
Clean and paint the steel portion of the structures.
NOW, THEREFORE, in consideration of the premises and to secure the
approval and prosecution of the said project, the parties hereto mutually
agree as follows:
1. That the said project when approved shall be undertaken, prose-
cuted and may be completed for and on behalf of the said City by the
Secretary acting in all things as its agent and said City hereby

constitutes and appoints said Secretary its agent, and all acts, pro-
ceedings, matters and things hereinafter done by the Secretary in
connection therewith are hereby by said City authorized, adopted,
ratified and confirmed to the same extent and with the same effect as
though done directly by the said City acting in its own individual
corporate capacity instead of by its agent.
2. The Secretary agrees to let the contract to perform the work
on the project in accordance with the approved specifications for the
project, to supervise the work and to administer the payments due the
contractor; or in the alternative, the Secretary may perform the work
with state highway forces in accordance with the approved specifications
for the project.
3. The Secretary agrees to do all the work described and pay all
the costs thereof whether done by contract or with its ovin'fo`rces.
4. The City agrees to adopt the necessary resolution and to take
such legal steps as may be required to give full effect to the terms
of this agreement and such traffic regulations as the Secretary deems
necessary to permit the work to be completed.

We are transmitting three copies of proposed Agreement No. 34-76M
for the above noted project covering the work to be performed in con-
nection with cleaning and painting the steel portion of the structures
on Interstate.70 over Alternate US 81 in north Salina. The main item
covered in this agreement is the agency clause. The routine mainte-
nance agreement remains in full force. The Secretary of Transportation
of the State of Kansas agrees to let the contract to perform the neces-
sary work and pay all the costs thereof. Will you please handle these
forms with the governing body for their review and action, if the
proposed agreement is satisfactory, the original and one copy should
be executed on the part of the City and returned to this office for our
further handling with the Secretary. The third copy may be retained in
your file for reference pending receipt of your fully executed copy. .
In connection with executing the agreement, the City will no doubt
find it necessary to pass a resolution authorizing the Mayor and the
City Clerk to execute the agreement. For your convenience, we are
enclosing one copy of a typical resolution frequently used by cities
on similar projects. We should be furnished a certified copy of such
resolution as the City adopts in order to complete our files for the
project. This project is tentatively scheduled for letting on June 17,
1976 and prompt action and return of the agreement forms by the City
would be greatly appreciated.
In the event that any questions should arise in connection with
the agreement, please feel free to call this office.
