This is to advise that the City Commission, in regular
session on April 28, 1975, voted unanimously to terminate
the lease agreement dated 1 May 1963 between the City
of Salina, Kansas, and the Kansas Landscape and Nursery
Company of Salina. This lease was assigned to you by
letter dated September 24,"1973, by Deputy City Manager
Bill Harris.
In accordance with the conditions of this lease, the
same will be terminated as of May 1, 1978.

LEASE AGREEMENT
This lease agreement made and entered into this 1 day of MAY ,
1963, by and between the CITY OF SALINA, KANSAS, a municipal corporation, hereinafter
referred to as the party of the first part, and KANSAS LANDSCAPE 6 NURSERY CO. Of
SALINA Kansas, hereinafter referred to as the party of the second part,
WITNESSETH:
That the party of the first part in considerating of the rents, covenants and
agreements of the said party of the second part hereinafter set forth does by these
presents grant, lease and rent unto the said party of the second part the following
described property situated in the County of Saline, State of Kansas, to -wit:
A tract of land contuining approximately six (6) acres bounded on
the east by the new channel of Dry Creek emptying into Mulberry
Creek;; and on the north by Mulberry Creek; and on the west'by a
line extending southeasterly from Muir's crossing on Mulberry
Creek; and on the south by the City of Salina, Kansas, flood
protection levee; all in the northeast quarter of Section.2,
Township 14 South, Range 3 West of the 6th Principle Meridian in
Saline County, Kansas.
To have and to hold the same unto the said party of the second part for a term of
five years commencing on the 1 day of MAY 1963, and that said party
of the second part in consideration of the leasing of the premises as above set forth
covenants and agrees with the said party of the first part to pay the said party of
the first part as rental for the same the sum of $ so_oo per year which said
rental shall be payable in advance prior to the commencement of each lease year.
The said party of the second part further agrees to plant nursery stock on said
land in a good and.workmanlike manner and to protect the same from waste.
After the termination of the primary term of this lease, this lease shall continue
as a lease from year to year under the same terms and conditions as herein set forth
unless terminated as hereinafter set forth. If either party to this lease desires
to renegotiate any provision of this lease, such party shall give written notice of
their desire to renegotiate said lease by registered mail addressed to the other party
at least three years prior to the and of any lease year.
If either party desires to terminate this lease, such party must give written
notice of its intention to terminate by registered mail addressed to the other party
at least three years prior to the beginning of any lease year.
The party of the second part shall not have the right to sublease the premises
covered by this lease or any portion thereof without the written consent of the party
of the first part.
The party of the second part agrees that he will use the premises for planting
of nursery stock only and agrees to indemnify and hold the City harmless from any and
all liability which may result from the party of the second part's use and operation
of the premises.
IN WITNESS WHEREOF the party of the first part has caused this contract to be
executed on its behalf by its Mayor and attested to by the City Clerk and has caused
its seal to be hereto affixed, and the party of.the second part has subscribed his
name all in the City of Salina, the day and year first above written.
