LEASE AGREEMENT
This lease agreement made and entered into this 'day
of , 1967, by and between the CITY OF SALINA, KANSAS, a
municipal corporation, hereinafter referred to as the party of the
first part, and ROLLAND McPHAIL, of Salina, Kansas, hereinafter re-
ferred to as the party of the second part,
WITNESSETH: .
That the party of the first part in consideration of the
rents, covenants and agreements of the said party of the second part
hereinafter set forth does by these presents grant, lease and rent
unto the said party of the second part the following described prop- -�
erty situated in the County of Saline, State of Kansas, to -wit:
A tract of land partly in the Southeast Quarter (SE'h) of
Section Seven (7), Township Fourteen (14) Range Two (2) West,
and partly in Section Eight (8), Township Fourteen (14) Range
Two (2) West, described as follows: All that part of land
lying seventy feet (70') east of the center line of flood con-
trol levee north of Iron Avenue,` West of Smoky Hill River
channel cut-off, and south of the south high bank of old chan-
nel of Smoky Hill River, except a two hundred foot (200') strip
of land, the east and west center line of which is the center
line of the new channel, beginning at flood control station
685 + 50 on the center line of levee and extending easterly to
Smoky Hill River cut-off channel, all in Saline County and
containing nine and three -tenths acres (9.3 A) more or less.
To have and to hold the same unto the said party of the second part

and that said party of the second part, in consideration of the leas-
ing of the premises as above set forth, covenants and agrees with the
said party of the first part to pay the said party of the first part
as rental for the same the sum of Ninety-three and No/100ths Dollars
(/9,ot
($93.00) per year which said rental shall be payable in advance prior
' to the commencement of each lease year.
The said party of the second part further agrees to farm
said land in a good and workmanlike manner and to protect the same
from waste.
After the termination of the primary term of this lease,
this lease shall continue as a lease from year to year under the same
terms and conditions as herein set forth unless terminated as herein-
after set forth. If either party to this lease desires to renegotiate

any provision of this lease, such party shall give written notice
of their desire to renegotiate said lease by registered mail addressed
to the other party at least thirty days prior to the end of any lease
year.
This lease is subject to termination by either party at the
end of any lease year. If either party desires to terminate this
lease, such party must give written notice of,its intention to termin-
ate by registered mail addressed to the other party at least sixty
days prior to the beginning of'any lease year.
The party of the second part shall riot have the right to
sublease the premises covered by this lease or any portion thereof
without the written consent of the party of the first part.
The party of the second part agrees that he will use the
premises for farming purposes only and agrees to indemnify and hold
the City harmless from any and all liability which may result from
the party of the second part's use and operation of the premises.
IN WITNESS WHEREOF the party of the first part has caused
this contract to be executed on its behalf by its Mayor and attested
to by the City Clerk and has caused its seal to be hereto affixed,
and the party of the second part has subscribed his name all in the
City of Salina, Kansas, the day and year first above written.

I hereby submit a proposal to lease from the City of
Salina, flood protection land as described:

I propose to pay to the City the sum of $50.00 per year
beginning with the year 1968
It is my plan to plant this land to alfalfa in the fall
of 1967 if season permits. If weather prevents sowing of
alfalfa this year, then another crop will be put in and
alfalfa sown in the fall of 1968.
I would like to lease this land for a period not less
than 5 years with an option to renew.
