This agreement is for water and sewer service to serve our Distribution Center located at Water Well Road and U.S. Highway 81 in your community. You will note that we have deleted Paragraph 11 from this agreement as it is against our company's policy to waive rights of this nature. With reference to the payment that we are,to make for this connection of $100 an acre, we will make this payment based on the acreage that was necessary to accommodate this Distribution Center and its expansion. This involved 26.64 acres. As you know, the remaining acreage consisted of portions of the public road and other property necessary to reach the Distribution Center by rail. We do not believe it is fair and reasonable to expect our company to pay the sum of $100 an acre for this portion of the property which is not needed in connection with this facility. It is our understanding that with this signed agreement you will immediately issue the necessary permit to the Law Construction Company for the construction of the water tap and the final hookup of the water main. Chase y __6-/97/ ii • ° s WATER CONNECTION AGREEMENT (OUTSIDE CITY LIMITS WATER WELL ROAD) This agreement, made and entered into this day of 19 by and between the CITY OF SALINA, KANSAS, hereinafter referred to as the "City" and hereinafter referred to as the "Consumer", WITNESSETH: In consideration of the payments herein provided and the mutual covenants and agreements herein contained, the parties do hereby mutually covenant and agree as follows: - Consumer hereby requests permission to make connection with the City water main and the City agrees to furnish water to the following described premises to -wit; under the following terms and conditions, to -wit; (1). Consumer agrees to pay the City for permission to connect to City water system the sum of $100.00 per acre. This fee shall include ser- vice to the sanitary sewer located from the'Union Pacific Railroad tracks west to the east entrance road to Westinghouse, and.from Water Well Road at the Union Pacific Railroad tracks north to the first WaterandSewerage Department sewage pump station. This fee does not include any costs of connecting to the main, deposit for meter; opening and closing of roadway, trench, special construction -requirements for railroad or highway crossings, etc. Any future expansion of the system within this acreage would be borne by the property owners under the direction of the Engineering Department of the City of Salina. Description of area to. be served is defined as above and shown in more detail by the attached map. (2): City agrees to provide the Consumer with the necessary water meter for which the Consumer agrees to post a cash deposit with the City which shall be equal to the City's cost for the meter. The deposit shall be refunded=to the Consumer upon return of the meter to the. City in proper operating condition; provided, however, that in the event the premises -served by this, application are annexed into the corporate limits of the City -within two years following` the date of this agreement said deposit shall be refunded to Consumer. Consumer agrees to pay all expenses connected with the installation of said meter which meter shall be installed at a location to be designated by the City and in accordance with specifications and requirements of all existing city ordinances or amendments thereto. Consumer agrees that any plumbing now existing or to be installed on the above premises will comply with all ordinances of the City and shall be subject to inspection by the City prior to connection with water main. Cost of inspection to be paid by Consumer. Consumer grants the City and its duly authorized employees or agents the right to inspect said premises at all reasonable times -to determine compliance with this.agreement and City ordinances pertaining to water service. (5). Consumer shall be responsible for maintenance and care of water meter as provided in the City ordinances. (6). City reserves the right to curtail or terminate water service in the event of unforeseen emergency or disaster and assumes no responsibility for damage resulting from variance in water pressure or volume. (7). Water service authorized by this agreement shall be used only for purpose of supplying water to warehouse and property owned by Consumer and no additional connections may be made thereto without the consent of the City. If any unauthorized connections are made, City shall immediately discontinue service. (8). A new application must be made and approved by the City for any change in ownership of the property, or in tenancy, or in the service as described in the application, and City shall have the right to discontinue the water supply until such new application is made and approved. (9). Consumer.shall not connect the City water supply with his own water supply or to any other system which would permit water from any other source to be countermingled with the City water supply. (10). All billings and collections shall be pursuant to City ordinances now in effect or as hereafter amended. (11). Consumer agrees that he will not protest annexation into the City at any time the City Commission may determine it in the best interest of the City •to annex said property. In other words what the Commission questioned was "other property necessary to reach the Distribution Center by rail; and the subsequent sentance relating to "this portion of the property which is not needed in connection with this facility." I would suggest in your letter to Western Auto asking for their check that you mention that the city does have x dollars of money invested in this trans- mission line, that the initial formula was established to amortize the line equitably throughout the lines it would serve, others have paid their fair share of the investment, we know that Western Auto would expect to do likewise. If we delete that portion of the county road right-of-way abutting your property, the figure is reduced to 36.63 acres. When this area of land and other surrounding properties was improved to provide water and sewer services, the City of Salina invested a considerable amount of money in a water main and sewer line. The equitable formula established at that time to amortize these installa- tions was $100.00 per acre with a minimum of ten acres. In the past, this formula has been applied to other industrial sites for their fair share of the investment, and I am sure Western Auto Supply Company would expect to be treated the same. Consumer agrees to pay the City for permission to connect to City water system the sum of $100.00 per acre. This fee shall include ser- vice to the sanitary sewer located from the Union Pacific Railroad tracks west to the east entrance road to Westinghouse, and from Water Well Road at the Union Pacific Railroad tracks north to the first Water and Sewerage Department sewage pump station. This fee does not include any costs of connecting to the main, deposit for meter; opening and closing of roadway, trench, special construction requirements for railroad or highway crossings, etc. Any future expansion of the system within this acreage would be borne by the property owners under the direction of the Engineering Department of the City of Salina. Description of area to be served is defined as above and shown in more detail by the attached map. - -- (2). City agrees to provide the Consumer with the necessary water meter for which the Consumer agrees to post a cash deposit with the City which shall be equal to the City's cost for the meter. The deposit shall be. refunded -to the Consumer upon return of the meter to the City in proper operating condition; provided, however, that in the event the premises served by this, application ' are annexed into the corporate limits of the City within two years following' the date of this agreement said deposit shall be refunded to Consumer. Consumer agrees to pay all expenses connected with the installation of.said meter which meter shall be installed at a location to be designated by the City and in accordance with specifications and requirements of all existing city ordinances or amendments thereto. Consumer agrees that any plumbing now existing or to be installed on the above premises will comply with all ordinances of the City and shall be subject to inspection by the City prior to connection with water main. Cost of inspection to be paid by Consumer. Consumer grants the City and its duly authorized employees or agents the right to inspect said premises at all reasonable times to determine compliance with this agreement and City ordinances pertaining to water service. . M . Consumer shall be responsible for maintenance and care of water meter as provided in the City ordinances. (6). City reserves the right to curtail or terminate water service in the event.of unforeseen emergency or disaster and assumes no responsibility for damage resulting from variance in water pressure or volume. (7). Water service authorized by this agreement shall be used only for purpose of supplying water to warehouse and property owned by Consumer and no additional connections may be made thereto without the consent of the City. If any unauthorized connections are made, City shall immediately discontinue service. (8). A new application must be made and approved by the City for any change in ownership of the.property, or,in tenancy, or in the service as described in the application, and City shall have the right to discontinue the water supply until such new application is made and approved. (9). Consumer shall not connect the City water supply with his own water supply or to any other system which would permit water from any other source to be countermingled with the City water supply. (10). All billings and collections shall be pursuant to City ordinances now in effect or as hereafter amended. This new facility is outside -city. 2. Western Auto requires written approval, from City of Salina, that we will allow the automatic alarms (Burglar, Fire and Sprinkler) to be tied into our E.O.C. However, I propose (if such approval is granted) that the ADT panels, fbr these and other such alarm connections, be placed in the wall cabinet (located in the Desk Sgt, area -1st. floor of Police Administration Bldg.). Burglar Alarm, for Western Auto Facility, being outside -city, our Police Dispatcher would receive the alarm and merely pass the information to the Sheriff Dept, for necessary action. Fire Alarm, for Western Auto Should they contract, for such service, the Dispatcher would alert F.D. Until such contract is forthcoming, the Dispatcher would contact Assaria Fire Department (the Rural Fire District Fire Dept.). Sprinkler Supervisory Service Alarm -Western Auto The same would hold true, as the fire alarm, except we would also require the telephone numbers of those servicemen (as would be indicated by Western Auto and ADT) who would take care of the system (check out trouble, re -set system, etc.). 3. For the above "alarm receiving service" (the Sprinkler Supervisory Service Alarm), the City of Salina would receive $25.00 per month. Letter dated July 12, 1971 -relative to ADT Burglar Alarm Panel 1. ADT will install a panel, which will accomodate future Burglar Alarm subscrib- ers (plus, allowing the burglar alarms that are presently wired in to the con- sole to be moved) in the wall cabinet, located in the Desk Sgt. area. This Agreement has been reviewed by our Vice President and General Counsel and we feel that Paragraph 11 of the Agreement is an unreasonable provision since we would be waiving all of our rights at this time and the future in connection with this provision. In selecting your City for our Distribution Center we did not ask or request any concessions from the city which normally are requested by firms constructing facilities of the size and type that we are constructing. In view of the above, we feel that this provision is unfair and would appreciate the opportunity of discussing this matter at the earliest possible date with your City Commissioners. Chase WATER CONNECTION AGREEMENT (OUTSIDE CITY LIMITS WATER WELL ROAD) This agreement, made and entered into this day of 19 by and between the CITY OF SALINA, KANSAS, hereinafter referred to as the "City" and hereinafter referred to as the "Consumer", WITNESSETH: In consideration of the payments herein provided and the mutual covenants and agreements herein contained, the parties do hereby mutually covenant and agree as follows: Consumer hereby requests permission to make connection with the City water main and the City agrees to furnish water to the following described premises to -wit; under the following terms and conditions, to -wit; (1). Consumer agrees to pay the City for permission to connect to City water system the sum of $100.00 per acre. This fee shall include ser- vice to the sanitary sewer located from the'Union Pacific Railroad tracks west to the east entrance road to Westinghouse, and from Water Well Road at the Union Pacific Railroad tracks north to the first Water and Sewerage Department sewage pump station. This fee does not include anv costs of connecting to the main, deposit for meter, opening and closing of roadway; trench, special construction requirements for railroad or highway crossings, etc. Any future expansion of the system within this acreage would be borne by the property owners under the direction of the Engineering Department of the City of Salina. Description of area to, be served is defined as above and shown in more detail by the attached map. (2): City agrees to provide the Consumer with the necessary water meter for which the Consumer agrees to post a cash deposit with the City which shall be equal to the City's cost for the meter. The deposit shall be refunded to the Consumer upon return of the meter to the -City .in proper operating condition; provided, however, that in the event the premises served by this, application are annexed into the corporate limits -of the City -within two years following' the date of this agreement said deposit shall be refunded to Consumer. Consumer agrees to pay all expenses connected with the installation of said meter which meter shall be installed at a location to be designated by the City and in accordance with specifications and requirements of all existing city ordinances or amendments thereto (4). Consumer agrees that any plumbing now existing or to be installed on the above premises will comply with all ordinances of the City and shall be subject to inspection by the City prior to connection with water main. Cost of inspection to be paid by Consumer. Consumer grants the City and its duly authorized employees or agents the right to inspect said premises at all reasonable times.to determine compliance with this agreement and City ordinances. 0 pertaining to water service. (5). Consumer shall be responsible for maintenance and care of water meter as provided in the City ordinances. (6). City reserves the right to curtail or terminate water service in the event of unforeseen emergency or disaster and assumes no responsibility for damage resulting from variance in water pressure or volume. Water service authorized by this agreement shall be used only for purpose of supplying water to warehouse and property owned by Consumer and no additional connections may be made thereto without the consent of the City. If any unauthorized connections are made, City shall immediately discontinue service. (8). A new application must be made and approved by the City for any change in ownership of the property, or in tenancy, or in the service as described in the application, and City shall have the right to discontinue the water supply until such new application is made and approved. (9). Consumer shall not connect the City water supply with his own water supply or to any other system which would permit water from any other source to be countermingled with the City water supply. (10). All billings and collections shall be pursuant to City ordinances now in effect or as hereafter amended. (11). Consumer agrees that he will not protest annexation into the City at any time the City Commission may determine it in the best interest of the City -to annex said property. AREA CODE 913 TA 7.7241 1 May 1970 In reply to your letter of 24 April 1970, asking about the fire flow available at a site north of the Westinghouse plant location, I would like to offer the following. A fire flow test was taken by our Fire Department with the following results: With one 2-1/2" nozzle open, the static pressure was 84 pounds; the residual pressure was 73 pounds which resulted in a flow of 1,420. gallons per minute. Reducing this to a 20 pound residual would give you in excess of 4,000 gallons per minute. This was off a 12 inch line that has approximately 178 feet of head. Our main line, located in the road, is a 24 inch cast iron line and riding on this is a 1.6 million gallon reservoir that is fed directly from our main water plant. In addition, if need be, water plant #2, located east of the proposed site (approximately one-half mile) could be activated and produce in excess of 1,000 gallons per minute. As to your question regarding the installation of a grease trap in your proposed service facility, I have conversed with the Director of Safety, Mr. McCabe and the plumbing inspector, Mr. Turner, and they advised me that any structure connected with the City of Salina water supply will have to conform to all our City ordinances including permits and inspections. It is their policy to review plans and specifications on individual basis making the decision at that time as to the necessity of grease traps. Since this property is in the county, our present policy in the Water and Sewerage Department is that your client should provide in writing tc the City` Commission or City Manager, Mr. Norris Olson their plans in regards to connecting to our municipal water and sanitary sewer systems. We would appreciate your help in obtaining any information available on flow test results or the amount of flow available (in qpm) in the 24" water main along Water Wells Road. We are trying to determine if the flow at that point is sufficient to serve the sprinkler system and satisfy the insuring agency for this project. The site we are speaking of, as I understand it, is directly across from the Westinghouse Plant. I would also like clarification on a sanitation problem. We will have a lunchroom facility in the building which will include a hand sink, a double -bowl sink and a small domestic type dishwasher for washing glassware. We understand we are to design our plumbing system based on the Uniform Plumbing Code which states that a grease trap should be installed in a kitchen or lunchroom facility if the local authority judges that it is required. I do not feel that there will be a large amount of on-site cooking or grease problems however I am asking for your local interpretation as to whether or not a grease trap is necessary on --this double -bowl sink. -- -- Your Your prompt attention to this inquiry would be most appreciated as we are trying to complete design work on our drawings for release for bidding on May 41 1970. It has been our policy in the past to look at each and all such places on their own plans. If at the time of review of the plans we can ascertain that the amount of grease is insufficient to create a problem to our satisfaction then the grease trap can be deleted, we do like to do this an an individual basis so thatway we feel that we can control things better, Laverne
