It is a condition of this lease that the Lessee shall not assign *this lease without the written consent of the City having been first had d obtained. That it is the purpose of the Lessee to employ said facilities the storage of private aircraft, which aircraft will use the municipal k\lity aforesaid, and it is understood that such purpose is directly, entally and necessarily required for the successful and proper opera- _ f said municipal airport. Nothing in this lease, except the right � t _ of the Lessee to occupy the specific lands aforesaid, shall be deemed to give the Lessee any exclusive privilege upon said airport, it being under- stood that it is the duty of the City to impartially operate said airport on an equal basis to all users of aircraft for aviation purposes. It is understood that this lease is subject to all the terms and conditions of leases heretofore signed and authorized by the City, or its officers, and all such leases are hereby incorporated herein by reference. The Lessee is hereby granted an=option to extend this lease for an additional term of five (5) year9,an the same terms and conditions as hrarein provided for. In the event +he City makes bona fide provision for the improve- ment of said airport sn such a way that the lands hereinbefore let are need- ed by it for the, 'nstallation of 'improvements thereon by the City, its agents and Q,..rractors, that thereupon the City will have'the right to cannel this iso,* upon ninety (90)•days I notice in writing, In the event of such c nation, the Lessee shall cause the improvements situate on the specific Rion of land herein let to be removed therefrom within the said period of ninety (90) days. In the event of such cancellation and removal, the City agrees to cause to.be furnished unto the Lessee herein an equivalent area of land on said airport for the remainder of the term or the option term •hereof - for like consideration as heroin provided. Upon the expiration.of the term or the option term hereof, as applicable, the Lessee shall cause all improvements and installations then pe oned by him and situate on.the said airport under the specific provisions hereof to.be fully removed therefrom and the lands restored to a substan- tially like condition as when let, or,in lisu thereof, the City may permit said improvements to there .remain by the'affirmative action of its govern- ing body prior to the termination of•the lease... The Lessee shall immediately, prier to commencing the construction of a hangar, purchase a,landlordse and tenants* public liability and prop- erty damage insurance policy or policies of. $50,000/$100,000415,000.'and cause the City to'be named as an.insured,therein, covering the Lessees use of the specific parcel of 1andso aforesaid] and his operations on the munici- pal airport, as aforesaid. Said premiums, to accrue on said policy or poli- cies shall be timely paid; a copy,of said policy shall forthwith be depos- ited with the City Clerk of the City of Salina, Kansas,,and praper renewal certificates or like subsisting.policies shall be timely deposited with the City Clerk to establish that such insurance is continuously subsistent. The -lessee hereby indemnifies the'City against any lose as a con- sequence of the uses aforesaid or other causes resulting from the use of said airport, as aforesaid, or the hangar and storage facilities aforesaid, or resulting from any act or omission of the Lessee, his agents, servants, employees, associates, guests or sub -lessees. In the event of any loss by the City, as aforesaidi the Lessee shall forthwith fully restore the City, including any judgments by it paid, court costs, attorneys' fees, and any other expenses.
