airport auth ball field leaseLEASE Jan This Indenture, made and entered into this 10th day of �, 1978 AV17, by and between the SALINA AIRPORT AUTHORITY of Salina, Saline County, Kansas, hereinafter referred to as the "Authority", and the CITY OF SA.M, KANSAS, a municipal corporation, hereinafter referred to as the "City", WITNESSETH: The Authority, for a good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does by these presents hereby let and lease unto the City the following described premises, to wit: All that area located in the Schilling Subdivision to the City of Salina, Saline County, Kansas, as indicated on the map attached hereto marked Exhibit "A" and made a part hereof by reference, together with the appurtenances thereuntp belonging, hereinafter referred to as the "Premises". (1). Terni of Lease: To have and to hold for and during a term of one year ccimiencing on the 1st day of December, 1977, and terminating on the 30th day of November, 1978, inclusive. (2). Use of Premises: The City agrees to use the premises for recrea- tional purposes, which shall consist primarily of baseball, softball and other types recreation and other activities usually connected therewith and incidental thereto. (3). Improvements to Premises: Authority grants the City permission to construct and maintain such baseball field as may be necessary for the recreational activities proposed on the Premises by the City. (4). Removal of Fixtures: That on or before the expiration of this lease or any extension thereof the City shall vacate the demised premises and remove its property therefrom and restore the premises to substantially the same condition as existed prior to the commencement of this lease. (5). Maintenance of Area: City agrees that it will use its best efforts to keep the premises in a safe, clean and wholesome condition and will not allow rubbish, trash, paper or other items to accumulate on said property or to be scattered on adjacent property. (6). Extension of Lease: After the primary term, this lease shall continue on a year to year basis on the same terms and conditions as here- in stated; provided however, that either party may cancel said lease by giving to the other party thirty (30) days written notice prior to the end of any lease year or extension thereof of its intention to terminate said lease. (7). Approval of FAA: This agreement is subject to the approval of the Federal Aviation Administration and in the event such approval is not secured this agreement shall be null and void. (8). Extent of Agreement: This lease shall be binding upon the successors and assigns of the respective parties to this agreement.
