of horses, but because the area has been newly fenced by barb wire
which is not permited under Section 8-408 of the City Code (any
person who shall make any enclosure with of by means of barb wire
except when the same is installed at a height of six (6) feet
three (3) inches or more shall be quility of a misdemeanor).
I am unable to recommend approval of -this request at this time.
If an approved fence was installed I would be able to approve this

I want to complain about the horses being put on the ground across
the street - 1712 East Cloud.
When this land was taken into the city, we were told no new
livestock would be allowed. There have never been cattle or
horses on that place. The acreage is too small and too close to
other houses to be kept clean and sanitary.
I live across the street at 1717 East Cloud. I can smell horse
manure and when I sit on my front porch the odor is unbearable.
The people who have the horses feed them close to their house and
also Harper's house instead of a far corner of the place.
The fences aren't constructed according to specifications, some of
it is barbed wire.
This problem not only is hard to live around, but it is also
reducing the value of our homes.
I would appreciate it very much if you could check into this
situation. Make them live up to the rules set at the time the
city made our property part of the city.

Helen L. Shamburg filed this Request for Permit to Keep Riding Horses in the
City Limits at 1712 East Cloud on May 27, 1987. However, developments
surrounding the keeping of horses on this property began more than a month
earlier. Flood Control personnel first contacted Ms. Shamburg about her fence
encroaching on the dike. In response, she moved the fence without applying for
a permit. Later, a complaint was received about the horses on Ms. Shamburg's
property. In response to this complaint, representatives of both the Health
Department and the Permit and Inspection Divi'sion visited the site. As of May
28, the Health Department found that the property met all of the recommended
standards for the keeping of horses. However, the Permit and Inspection
Division finds three violations of the City Building Code: improper materials,
the newly installed barbed wire; improper placement of the animal enclosure,
not set back at least 100 feet from all property lines; and no permit for the
new fencing.'
The City has received within the past week letters from two neighbors of the
Cloud property protesting the keeping, of the animals.
At this time, both the Health Department and the Permit and Inspection Division
recommend denial of this request to keep riding horses on the basis of improper
materials in the fencing, improper location of the enclosure and lack of permit
for the fencing. As of press time, Ms. Shamburg had not requested an exemption
for the barbed wire, had not filed a request for a variance on the setbacks and
had not applied for a fence permit:

SUBJECT: Permit for owning or maintaining horses inside the city limits
for riding purposes at 1712 E. Cloud filed by Larry Shamburg
The minimum requirements for the aforementioned activity come from
two separate chapters of the Salina Code of Ordinances. Chapter 7, Art.
III, Sec. 7-31 (c) states that a special permit for such purpose must be
granted by the Board of Commissioners. It adds that the designated areas
are not to become a nuisance or a flybreeding or rat -infested area.
Chapter 42, Article XIV, Sec. 42-619 requires that the parcel of
land for pasturage contain a minimum of five acres and that the feeding,
grazing or sheltering not take place within 100 feet of any lot line.
At the present time, according to data I have received, the
Shamburgs have violated all of these requirements. Prior to requesting
the permit, horses were placed on this property. According to complaint
letters received by the City, the animals are creating an offensive odor
and a problem with flies. The current land by deed description is 2
acres or less. The Engineering Department found it to be 1.88 acres.
Finally, the Shamburgs are allowing the horses to feed and graze
right up to all four lot lines. In addition to these issues, fences
were constructed without a permit, and barbed wire was used as a fencing
material.
The nature of the violations as well as the complaints presented by
the neighbors would indicate this particular issue can not be resolved.
For this reason, the staff recommendation is that the permit be denied
and that Mr. Shamburg be given ten (10) days to remove the horses from
the property. At first glance, this may seem to be a short time frame.
However, the Shamburgs have been advised throughout this process that
the horses might have to be removed and that contingency plans for such
a situation should be made. Also, the letters from the neighbors
indicate that the nuisance created by the horses is very offensive to
them. For these reasons, ten days seems an adquate length of time.

Please do not issue a permit to Larry Shamberg or anyone else for
stable or horses at 1712 E. Cloud. This property is in the city limits
and horses have never been on this property.
We have lived here for nearly 49 years. There is only 1.888 acre of
ground and it is too close to our home and Mrs. Newcomb to have horses.
We had the police out last week to have them clean up the manure and
wet hay. Two pick up loads were cleaned up in one corner next to our
back yard.
The nice fence Helen Shamberg built to keep her horses out of the
corner lasted only a few days. The horses broke the board fence down
last night. These horses have no shelter from rain or storms.
This is. a sample of what we will have if they are allowed to keep
horses there. .Oui property will be devaluated greatly if these horses
remain. It is like living in a barnyard.
Nothing has changed since Helen Shamberg applied - the flies are still
terrible as are the dust and smell from the horses. The only time the
horses are sprayed for flies is when they want to ride them.
You are not being fair to us or Mrs. Newcomb if you issue this permit!
Mrs. Newcomb is nearly 93 years old and uses a walker. She is a
retired school teacher. If she goes to her front porch to sit, the
flies make it impossible.
The flies come in whenever we open our doors to go outside. The horses
throw the dust on their legs and stomach to fight off the flies making
the dust problem worse.
Even after they hauled off the manure, the ground still smells for they
wet there for three weeks and still continue to do so.
We are sure you wouldn't want some one to move three horses next door
to your home and we don't like it either.
Please do not issue this permit for stables at 17.12 E. Cloud.

SUBJECT: Permit for owning or maintaining horses inside the city limits
for riding purposes at 1712 E. Cloud filed by Larry Shamburg
The minimum requirements for the aforementioned activity come from
two separate chapters of the Salina Code of Ordinances. Chapter 7, Art.
III, Sec. 7-31 (c) states that a special permit for such purpose must be
granted by the Board of Commissioners. It adds that the designated areas
are not to become a nuisance or a flybreeding or rat -infested area.
Chapter 42, Article XIV, Sec. 42-619 requires that the parcel of
land for pasturage contain a minimum of five acres and that the feeding,
grazing or sheltering not take place within 100 feet of any lot line.
At the present time, according to data I have received, the
Shamburgs have violated all of these requirements. Prior to requesting
the permit, horses were placed on this property. According to complaint
letters received by the City, the animals are creating an offensive odor
and a problem with flies. The current land by deed description is 2
acres or less. The Engineering Department found it to be 1.88 acres.
Finally, the Shamburgs are allowing the horses to feed and graze
right up to all four lot lines. In addition to these issues, fences
were constructed without a permit, and barbed wire was used as a fencing
material.
The nature of the violations as well as the complaints presented by
the neighbors would indicate this particular issue can not be resolved.
For this reason, the staff recommendation is that the permit be denied
and that Mr. Shamburg be given ten (10) days to remove the horses from
the property. At first glance, this may seem to be a short time frame.
However, the Shamburgs have been advised throughout this process that
the horses might have to be removed and that contingency plans for such
a situation should be made. Also, the letters from the neighbors
indicate that the nuisance created by the horses is very offensive to
them. For these reasons, ten days seems an adquate length of time.

Dear Commissioners:
Please do not issue a permit to Larry Shamberg or anyone else for
stable or horses at 1712 E. Cloud. This property is in the city limits
and horses have never been on this property.
We have lived here for nearly 49 years. There is only 1.888 acre of
ground and it is too close to our home and Mrs. Newcomb to have horses.
We had the police out last week to have them clean up the manure and
wet hay. Two pick up loads were cleaned up in one corner next to our
back yard.
The nice fence Helen Shamberg built to keep her horses out of the
corner lasted only a few days. The horses broke the board fence down
last night. These horses have no shelter from rain or storms.
This is & sample:, of what we will have if they are allowed to keep
horses there. .Our property will be devaluated greatly if these horses
remain. It is like living in a barnyard~
Nothing has change& since Helen-Shamberg applied - the flies are still
terrible as are the dust and smell from the horses. The only time the
horses are sprayed for flies is when they want to ride them.,
You are not being fair to us or Mrs. Newcomb if you issue this permit!
Mrs. Newcomb is nearly 93 years old and uses a walker. She is a
retired school teacher. If she goes to her front porch to sit, the
flies make it impossible.
The flies come in whenever we open our doors to go outside. The horses
throw the dust on their legs and stomach to fight off the flies making
the dust problem worse.
Even after they hauled off the manure, the ground still smells for they
wet there for three weeks and still continue to do so.
We are sure you wouldn't want some one to move three horses next door
to your hone and we don't like it either.
Please do not issue this permit for stables at 1712 E. Cloud..

Dear Commissioners:
I want to complain about the horses being put on the ground across
the street at 1712 East Cloud.
When this land was taken into the city, we were told that no new
livestock would be allowed. There have never been cattle or horses
on that place. The acreage is too small and too close to other
houses to be kept clean and sanitary.
I live across the: street at 1717 East Cloud. I can smell horse
manure and when I -sit on my front porch, the odor is unbearable.
The people -who _have the horses feed them -close to their house and
also Harper's house instead of a far corner of the place.
The fences -aren't constructed according to specifications, some of
it is barbed wire.
After these horses have been at 1712 E. Cloud for 4 weeks, we have had
a sample of what we will have°to contend with if the law is not
upheld. The flies,dust and smell are worse than before.
This problem not only is hard to live around, but it is also reducing
the value of our homes.
I would appreciate it very much if you would check into this situation
as it is not a good one! See to it that they obey the rules set at
the time our peroperty was taken into the city limits.

constantly.
As I have arthritis and not able to walk long distances, the mule
is used for coon hunting at night. He also competes in jumping contests
and has been in several parades. Enclosed are a few pictures of the
mule in parades and jumping contests.
I have ample pasture, plus a ton of hay and oats for winter use.
The mule keeps all weeds, including bindweeds, down and he is a
family pet.
I have never had a neighbor complain about any of my animals.

We ask that you present this letter to the City Commission
during their next meeting for their approval prior to our
formal request for a building permit. Our firm is the
owner of approximately 40 acres immediately west and
adjoining the boundry of Lakewood Park and our land lies
between the west boundry of Lakewood Park and the river and
Ohio Street, It is our desire to construct a horse stable
on Block 6 as indicated on the plat of Lakewood Addition
and the building inspector of the City of Salina has
advised me that we will require prior authorization from
the City Commission before a permit can be issued.
The structure will be approximately 38' wide and 72' long
and will be a combination stables and utility barn and will
be intended to contain not more than four horses. The
structure will be well beyond the 50' required from any
residence dwelling in all directions and in other aspects
will comply with the codes of,the City of Salina. If you

istrative authority other than to comply with it as
written. It is my opinion that the City Commissioners
and the Health Department do appreciate the past condi-
tions that have existed in your area, and will not hesi-
tate to revoke this permit after giving Mrs. Elliott a
fair opportunity to get into compliance.

Horses which are used for riding purposes only may be
stabled within the city limits only in designated areas :which
have'been give'n a special permit for the purpose by the city
commissioners. Such designated areas,'for purposes of health
and sanitation, shall be under the supervision of the health -
officer. If at any time such designated areas shall become a
nuisance or a fly breeding or rat harborage area, the health
officer shall have the authority to revoke such s ecial r 't
within ten (10) days after notifying the city commissioners

A. The distance between the exterior limits of, the place where a horse,
or'horses, are -kept and the exterior limits of the nearest dwelling
.occupied by any person other than the applicant, owner, or oarmit
holder shall not be less than fifty feet (50'), for permitting, per
horse in the City of Salina one-half (2) acre together (21,780
square feet).
B.. Every keeper of any horse(s) shall confine in an enclosure sufficient
to prevent their running at large, and such enclosure shall be main-
tained in a clean and sanitary condition at- all times and an approved
Insecticide shall be used as often as deemed necessary. Also, he
shall provide' adequate and sanitary drainage for the area.
C._ Every keeper of any horse(s) in the City of Saline shall cause the
litter and droppings therefrom to be collected trice a week in a
closed container or receptacle of such a type that when closed it is
ratproof and flyproof. At least ,twice each ::geek, each such .keeper
shall cause all litter and droppings so collected to be disposed of
In such a way as not to permit the presence of fly larvae.
D. Every keeper of any horse(s) in the City of Salina shall cause all
feed grain provided therefor to be stored and kept in a closed rat -
proof, fly-tight/building, box, container or receptacle.

Dear Mr. Srack:
There is no specific outlines for procedures regarding the issuance of
permits for keeping horses in the city limits under 5-110. We will
probably be getting requests before long so I would like to suggest
that the following routine be followed if it meets with your approvals
1. Applicant comae to City Clerk and makes written request for permit
(suggested form'is attached).
2. City Clerk then sends the request to this office for us to check
over the area and make recommendations.
3. If we approve (or disapprove) after investigation, we will make a
notation to that effect and return the request form to the City
Clerk who will then bring it to your attention.
4. You can then take it up with City Commissioners to grant or dis-
approve the request.
5. City Clerk will then notify the person making request that it has
been granted (or disapproved) and keep the form on file. We will
also keep a file of requests and if we approve, we will consider
the request as granted unless the City Clerk notifies us to the
contrary. Likewise, if we approve and the City Commissioners dis-
approve, we will then check to see that the horse or horses are
removed from the city limits.
If there is another procedure that you think will be better, please let
me know and we will be very glad to go along with your recommendations.
The Zoning Board Should be consulted, too, in case there are am restric-
tions on the area involved.
