GRANT OF PERMANENT DRAINAGE EASEMENT
Gary L. Poulton, (the "Grantor"), being the owner of the hereinafter described real
estate which is part of a retail and restaurant development site located on Lot 14, less
the North 10 feet thereof, and Lot 15, less the South 174.3 feet thereof, in Block 9 of
the Key Acres Addition to the City of Salina, Saline County, Kansas, according to the
corrected plat thereof, and addressed as 2525 South Market Place in Salina, Kansas
does hereby give, grant, dedicate, and convey unto the City of Salina, Kansas, a
municipal corporation, (the "Grantee")
A Permanent Drainage Easement, in perpetuity, on the real estate legally
described on the attached and incorporated Exhibit A and depicted on the
attached and incorporated Exhibit B for the purposes of locating, constructing,
excavating, and maintaining:
Stormwater detention facilities, including pipelines, ditches, swales, rip rap and
other erosion control devices for the purpose of collecting, detaining and
transmitting surface stormwater from the hotel site on to Kansas Department of
Transportation right-of-way adjacent to the site.
Grantor acknowledges that this Grant of Permanent Drainage Easement shall neither
alter nor affect the Grantor's obligation to maintain the easement area which shall
continue to be maintained in a state of good repair by the owner of the hotel site.
Grantor hereby covenants that they are the lawful owners of the described premises
and have the right, power, and authority to convey the rights granted hereby.
