J) ~..~~;...- ~.r.o~ 1 Date .Recorded: B/30/2010 12:03:26 PM 11111111111111111111111111111111111111111111I1111111111111II GRANT OF PERMANENT SIDEWALK EASEMENT Joan Wilson, Trustee of the Joan Wilson Trust dated March 15, 2005, ("the Grantor"), being the owner of the hereinafter described real estate, does hereby give, grant, dedicate, and convey unto the City of Salina, Kansas, a municipal corporation, (the "Grantee") A permanent easement, in perpetuity, over and across a strip of real property situated on Magnolia Road and located on Lot 8, Block 1 of Key Acres Addition to the City of Salina, Saline County (according to the corrected plat thereto) legally described and depicted on the attached Exhibit A for the purpose of pedestrian use by the public of a public sidewalk constructed thereon; with full authority to enter upon the easement to construct the sidewalk and, if Grantor fails to fulfill its legal responsibility relating to the safe condition of the sidewalk, with full authority to enter upon the easement to maintain, repair or replace the sidewalk on the basis allowed by law. Grantor acknowledges that this Grant of Permanent Sidewalk Easement shall neither alter nor affect the Grantor's obligation to maintain the described real estate. Grantor hereby covenants that it is the lawful owner of the described real estate and has the right, power, and authority to convey the rights granted hereby. Grantor further covenants that: (1) Grantor is the Trustee under the Trust; (2) the Trust is a revocable trust; (3) the Trust remains in full force and effect at this time; (4) Grantor is the duly qualified and acting Trustee under the Trust; and (5) as such Trustee, Grantor is authorized, pursuant to the Trust and without any limitation whatever, to convey all of the above-described Permanent Sidewalk Easement.
