land legally described as the west 9.6 acres of Lot 1, Block 1, Kessler
Addition to the City of Salina, Kansas. (Approximately 500-698 W. Euclid

On September 3, 1985, the Salina City Planning Commission conducted a public
hearing on Application #Z85-11 as referenced above. This application would, if
approved, rezone this tract from RS to C-6. After the public hearing, the
Planning Commission unanimously (7-0) recommended this application be approved
subject to the following restrictions:
1. That the applicant comply with the screening provisions of Salina City Code
Section 42-336(2).
2. That .the applicant comply with the exterior lighting restrictions of Code
Section 42-336(3).
This recommendation is based upon the following findings-of-fact:
1. The change in classification is consistent with the intent and purpose of the
zoning code;
2. Every use that would be permitted on this property if it were reclassified
would be compatible with uses permitted on other property in the immediate
vicinity;
3. Adequate public utilities and services exist or can be provided to serve any
uses which would be permitted on this tract if it were reclassified;
4. The proposed amendment will not correct any known error in the application of
the zoning regulations;
5. This amendment is made necessary by changing conditions in the area.

AN ORDINANCE PROVIDING FOR Tt-IE AMENDMENT OF ORDINANCE
NUMBER 8526, THE SAME BEING CHAPTER ~,2 OF TIlE SALINA CODE, AND THE
ZONIHG DISTRICT MAP THEREIt4 AND THEREBY ADOPTED AND PRCVIDING
FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND
PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for ~,he amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described has
been timely complied with, ane SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. AMENDMENT. DISTRICT C-6. HEAVY COMMERCIAL
DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly
adopted arid published as a part of Ordinance Number 8526, the same being
Chapter 42 of the Salina Code, be and it is hereby amended so that the following
described property be rezoned as follows, to wit:
The West 9.6 Acres of Lot 1, Block 1, Kessler Addition
to the City of Salina, Saline County, Kansas
shall become a part of District C-6. HEAVY COMMERCIAL DISTRICT. That the
use of said described property shall be subject to all the conditions, restrictions
and limitations as made and providea for in Ordinance Number 8526, the same
being Chapter 42 of the Salina Code, with reference to HEAVY COMMERCIAL
DISTRICTS.

and after its adoption and publication once in the official city newspaper.
