Item
Application #P93-3D, filed by Excel Development Group, requesting approval of a replat of the
Lots 1-11, Block 1 of Golden Eagle Estates Addition No.2.
Nature of Current Request
On July 19, 2002, the Excel Development Group submitted an application to replat Lots 1-11, Block
1 of Golden Eagle Estates Addition No.2 into a single platted lot. The replatting process is a
mechanism that can be used to vacate streets and easements, adjust or eliminate lot lines and to
dedicate new utility and drainage easements. In this case, the proposed replat would eliminate internal
lot lines and easements, dedicate new utility easements, and create a single 9.77-acre building lot for
a proposed housing facility for the elderly with frontage on both Eaglecrest Avenue and Magnolia Road.
A drainage easement would also be set aside for a proposed detention/retention pond on the west
edge of the lot.
Staff Comments
On September 23, 2002 the City Commission passed a motion 4-0 authorizing the Mayor to sign this
plat and accept the dedications offered by the property owner at that time - Golden Eagle Estates, Inc.
On September 26, 2002, before the plat could be recorded, Golden Eagle Estates, Inc. sold this
property to Eaglecrest, LLC thus nullifying the dedications and making the plat unrecordable. A new
plat has been prepared for signature by the authorized representatives of Eaglecrest, LLC of Lincoln,
Nebraska, so that they can indicate their intent to make the dedications to the public.
City Commission Action
Because of the change in ownership, a new motion should be made to authorize the Mayor to sign the
plat and accept the offered easement, right-of-way and restricted access dedications from the current
owner of the property - Eaglecrest, LLC.
Easements and Dedications
-Restricted access is being dedicated along Magnolia Road.
-An existing 40 ft. utility easement for the interceptor sewer line in the southeast corner of the lot and
a 20 ft. easement along the east property line are being retained.

.New 20 ft. utility easements are being dedicated for water main extensions that will serve public fire
hydrants located on Lot 1.
.KPL has requested that a 10ft. utility easement be dedicated along the south side of Eaglecrest
Avenue to get 3 phase service to the rear of the proposed apartment building on Lot 1.
.A drainage easement is being dedicated for the proposed retention/detention pond to insure that it
remains in place and is not modified without the City Engineer's approval. has had sections and design
of the pond in detail and has confirmed that the proposed pond design will in fact fit within the
easement set aside on the plat.
