GRANT OF PERMANENT DRAINAGE EASEMENT

TIllS INDENTURE, made this ~ day ofMa1~ 2010, by and between Cornerstone
Development Group, L.L.c., (the "Grantor") and the CITY OF SALINA, KANSAS, a municipal
corporation, (the "City"):
WITNESSETH: That the Grantor, for good and valuable consideration, does hereby
convey qnto the City that certain portion of land owned by the Grantor as legally described on
the attached and incorporated Exhibit A and depicted on the attached and incorporated Exhibit B
as a public drainage easement, in perpetuity, (the "Drainage Easement") for the purposes of
locating, constructing, excavating, and maintaining:
Stormwater pipelines, ditches, swales, rip rap and other erosion control devices fQr the
purpose of collecting and transmitting surface stormwater from the subdivision street
system to an off-site stormwater detention basin located in the Mariposa Addition.
Grantor acknowledges that this Grant of Permanent Drainage Easement shall neither alter
nor affect the obligation of the Grantor or Grantor's successors to maintain the described
real estate.
Grantor hereby covenants that they are the lawful owners of the described real estate and
have the right, power, and authority to convey the rights granted hereby.

Legal Description (20' Drainage Easement)
A parcel ofland located in Lots 4 and 5, Block 1, Grand Prairie Addition to the City of
Salina, Saline County, Kansas, being 20.0 feet in width and being used for drainage
easement purposes and is more particularly described as follows:
Beginning at the Northeast comer of said Lot 4;
- thence along the East line of said Lot 4 on a curve to the left with a radius of 50.00 feet,
a chord length of 10.00 feet, a chord bearing ofS 02018'00" E and an arc length of 10.02
feet;
- thence S 87056'46" W a distance of 131.32 feet to a point on the East line of a drainage
easement;
- thence N 14034'37" W along said East line a distance of20.49 feet;
- thence N 87056'46" E a distance of 137.72 feet to a point on the East line of said Lot 5;
- thence along said East line on a curve to the left with a radius of 50.00 feet, a chord
length of 10.20 feet, a chord bearing ofS 09017'36" W, and an arc length of 10.22 feet to
