Consider applications for annexation of five tracts of land located south of Schilling Road and west
of Ninth Street into the corporate limits of the city.
Background
Applications have been received from four property owners requesting annexation of their property into
the city limits. A fifth parcel consists of state highway fight-of-way for the abandoned on and off
ramps to Interstate 135 from Ninth Street. These tracts of land are located south of Schilling Road
between Ninth Street and 1-135 (see attached map). All four tracts as well as the 1-135 access road
right-of-way are unplatted and zoned agricultural. Altogether the area contains 116.74 acres.
The subject area (except for the right-of-way) is to be included in a benefit district for the installation
of water and sewer lines to serve existing and future development. This city utility project has been
discussed with the private property owners and each have submitted signed petitions for construction.
The petitions were submitted subject to city approval of a deferral of special assessments. Cities may
defer specials on agricultural tracts for 15 years or until such properties are platted or developed
whichever occurs first. The property must be annexed before an ordinance can be adopted by the City
Commission formally granting such a deferral.
The attached annexation ordinance is being introduced for first reading on July 12 with final action or
second reading scheduled for July 19 at which time several related items will also be presented. These
include a resolution deferring special assessments, an engineering feasibility report, a resolution of
advisability and authorization for the project and authorization to set a bid date.
Recommended Action
Adopt the attached ordinance on first reading annexing the subject properties.
