On August 11, 1986 the public hearing date was set for August 25, 1986 for
Engineering Projects 85-725 and 85-726 for street and utility improvements in
The River Place, Riverdale, Nord, Mayfair, Meyer, American Stores
Properties, Inc., Eastgate and Replat of Blocks 4, 10, 11, 12, Georgetown
Additions.
The Notice of Public Hearing was published on August 14, 1986.
This hearing is being held for the purpose of receiving comments, written or
oral, on the method of assessment for these Engineering Projects.
Ordinance Number 86-9154 - levying special assessments on lots, pieces, and
parcels of ground in the City of Salina, Kansas for the purpose of paying a
portion of the cost of street and utility improvements in The River Place,
Riverdale, Nord, Mayfair, Meyer, American Stores Properties, Inc., Eastgate
and Replat of Blocks 4, 10, 11, 12, Georgetown Additions, should be
introduced for first reading at the conclusion of the public hearing and then
adopted on September 8, 1986.

WHEREAS, the Board of Commissioners has determined that the total
cost of suci~ improvement is One Million Two Hundred Thirty-six Thousand Three
Hundred Ninety-four and 00/100 Dol!ars ($1,236,394.00), and that 98.57 percent
in the amount of One Million Two Hundred Eighteen Thousand Six Hundred
Seventy-five ar.d 20/100 Dollars {1,218,675.20) be assessed against the
improvement districts and that 1.43 percent in the amount of Seventeen
Thousand Seven P. undred Eighteen and 80/100 Dollars ($17,7~,8.80) be assessed
against the city-at-large.
WHEREAS, the Board of Commissioners has, after due notice, met and
determined the amount of special assessments, SO NOW, THEREFORE
BE IT ORDAINED by the Coverning Body of the City of Salina,
Kansas:
Section 1. That special assessments to pay the cost of such
improvements, .with accrued interest, be and the same are hereby levieo against
the several lots, pieces and parcels of land liable for special assessments for

~ Section 2. Said amounts so levied, apportioned a~d assessed as
l! aforesaid will be due and collectible in te~ equal i:~stallrr,ents, the first becoming
due with the taxes levied for tl",e year 1985, and one of said instalments falling
due each and every year thereafter until all are paid and ali to be collected with
nterest as in this ordinance provided, HO~A'EVER, that the owner of any piece
or parcel of property liable for any such assessments may redeem his property i
from such liability by paying to the City Treasurer the entire amount chargeable !
aqainst the same, as in this ordinance provided, at any time within thirty days !
after the publication of this ordinance and before the issuance of bonds of said '
iCity in paymer~t of the balar, ce of the cost of said improvements, the property so
paid on shall not thereafter be liable for ar.,,,' further assessments for the cost of
said improvements, nor for arty part of said bonds.
Section 3. There is hereby levied further and assessed against such
lots and pieces of ground described in this ordinance, interest at such rate per
annum as shali be borne by bonds hereafter to be issued for the payment of the
remaining unpaid cost of such improvements to be hereafter determined and fixed
b'/ ordinance, when such bonds are issued on all of said installments mentioned
and provided for in this ordinance, from the date of the bonds which may be
issued at the end of thirty days as specified in the preceding section hereof, as
by law provided, to the time of the collection of the installments as provided by
law, which said interest shall be collected and after the taking effect of this
i: ordinance and the fixing of said interest rate when such bonds are autl':orized
anc~ issued, however such interest rate shall not exceed 12 percent per annum,
it shall be the duty of the City Clerk of said City to annually, at the same time
other taxes are certified, and until alt of said assessments so apportioned and
levied have been certi.~ied to the County Clerk of Saline County, Kansas, certify
a full list' of all property liable to assessment and taxation for such work and
improvements, except such property on which the special assessments aforesaid
have been paid in full, as hereinbefore provided, together with the respective
amounts due on each of said lots and pieces of ground, which amounts shall
include the annual installments on special assessments together ~'ith the interest
for one year at the rate to be fixed as provided for in this ordinance, on all
unpaid balances of such assessments, such amounts so certified as herein
provided shall be placed upon the tax roll by tl~e County Clerk of Saline
County, Kansas, and collected as other taxes are collected.
Section 4. That this ordinance shall be in full force ar..d effect frcn~
and after its adoption and publication once in the official city newspaper.
