AGREEMENT FOR MUTUAL AID IN FIRE PROTECTION WHEREAS, it is deemed advisable for' the CITY OF SALINA, KANSAS and the SALINE COUNTY RURAL FIRE DISTRICT to secure the advantages of mutual assistance firefighting and fire protection for each party. NOW, THEREFORE, this agreement for Mutual Aid ,in Fire Protection is entered into this 29TH day of MARCH, 'j between the CITY OF SALINA, KANSAS, party of the first part, . 1988 ' . AND SALINE COUNTY RURAL FIRE PISTRICTS, party of the second part, for the purpose of securing to each the benefits of such mutual aid in the protection of life and property from fire or during other extreme, emergencies. IN CONSIDERATION OF THE MUTUAL AGREEMENTS HEREIN CONTAINED, THE' PARTIES AGREE AS FOLLOWS: 1. Upon a request initiated by .a chief officer of the SALINA FIRE DEPARTMENT to a representative of SALINE COUNTY RURAL FIRE DISTRICTS, fire fighting personnel and equipment may. be dispatched to any point within the city limits of Salina, Kansas as designated by such request. 2. Up~n a request initiated by a chief officer of the SALINE COUNTY RURAL FIRE DISTRICT to a representative of the SALINA FIRE DEPARTMENT, fire- fighting personnel and equipment may be dispatched to any point within SALINE COUNTY, KANSAS as designated by such request. 3. Any dispatch of personnel and equipment pursuant to this agreement is subject to the following conditions: (a) Any request for aid hereunder shall include. the name of the chief officer initiating the request. a statement of the amount an<;i type of equipment and number of personnel requested', and shall specify the location to which the equipment and personnel are to be dispatched, but the amount and type of equipment and number of personnel to be furnished shall be . determined by the chief officer in charge of the responding Fire Department. (b) The responding Fire Department shall report to the chief officer in charge of the requesting Fire Department at the location to which the equipment is dispatched and shall be subject to the ord~rs of . that officer. The responding equipment remains the property of the . responding department and the responding personnel remain the employees of the responding department and shall not be considered the equipment or employee personnel of the requesting department, even though they are under the direction of the requesting depart~ent. ;:\ " 'tl .~' Ll~: Mutual Aid -!ire Protection/Sa~~=- Co~~._i ~ (c) Responding fire equipment and personnel shall be released by the requesting Fire Department when the services of the responding fire equipment and personnel are no longer required or when the responding fire equipment and personnel are needed within the area for which it normally provided fire protection. 4. Each party waives all claims against the other party for compensation for any loss, damage, personal injury,' or death occurring as a consequence of the performance of this agreement. 5. No party shall be, reimbursed by the other party for any costs incurred pursuant to this agre~mene.. 6., This agreement shall commence and be e~fective upon the date first above mentioned and may thereafter be terminated by either party upon thirty (30) days' written notice' to the other. Said notice to be served upon the Governing Body, the City Manager, and the Fire Chief by regis.tered mall with return receipt. 7.. Either. party in this agreement shall retain the right to return said party's personnel or equipment to their respective department if said pe~son~el or equipment is needed for protection of the responding ~ depar~nt or recalled by the Fire Chief of such department. That the Mayor and City Clerk of the City of Salina are hereby authorized to execute an agreement for mutual aid In fire protection between the City of Salina, Kansas and the Saline County Rural Fire 'District to secure the advantages of mutual assistance firefighting and flre protection for each party.
