(Aquat erra) to perform professional engineering services for the Salina Municipal Solid Waste Landfill Facility (Landfill). BACKGROUND: In order to comply with EPA and KDHE regulations pertaining to the operation of the Landfill, the City is required to perform certain engineering services each year. Due to the complexity of the regulations and the special expertise necessary to meet these requirements, City staff contracts out these engineering services. In July of 2008, Salina hired Aquaterra to provi de landfill engineering services after a competitive proposal, interview, and reference checking proce ss. Staff believes Aquaterra has performed well enough to warrant a new agreement si nce the current one expires on March 1, 2010. Staff is proposing that this new agreement extend thru Februa ry 29, 2012, which will span over portions of three budget fiscal years. Exhibits have been provided in the agreement packet so that a comparison of tasks and budget years can be made to better determine total costs each year (2010 - 2012). Payment to Aquaterra will be based on actual costs incurred. Aquaterra is to provide the engineering services specified in each of the separate tasks as identified in the exhibits in the attached agreement or as requested by the City. However, the total compensation shall not exceed $212,500 during 2010, $184,550 for 2011, or $10,000 for 2012. Staff has reviewed this agreement and believes the fees for reoccurring tasks and new tasks are competitive and reasonable for the services provided. FISCAL NOTE: Sufficient funds have been budgeted within the 2010 Solid Waste budget to pay for the 2010 expenses. Funding for 2011 and 2012 has yet to be decided and task approvals are subject to annual City Commission appropriation. CONFORMANCE WITH THE STRATEGIC PLAN: Goal 3: The City will provide the highest quality of services, consistent with governing body direction, available resources, and staff commitment to quality. RECOMMENDATION: City staff requests the City Commission authorize the mayor to sign the Agreement with Aquaterra to perform professional engineering services for the Landfill in an amount not to exceed $212,500 during 2010, $184,550 during 2011, and $10,000 for 2012.
