Consider approval of resolution authorizing the filing of a plat for the city owned surplus right-of-way
at the Ohio/Belmont/Wayne intersection.
Backqround
The intersection of Ohio Street and Belmont Boulevard was redesigned and reconstructed in 2000.
As part of the realignment, Belmont Boulevard was shifted to the south to intersect with Wayne
Avenue east of Ohio. Wayne Avenue west of Ohio was also realigned to intersect with Belmont
Boulevard opposite Oxford Drive. To accomplish this the northwest corner of the Stewart Elementary
School grounds was acquired by the City. The realignment of Belmont Boulevard to the south has
resulted in the creation of a tract of right-of-way directly south of Sunflower Bank which is no longer
needed for public street purposes. This leftover right-of-way is criss-crossed by overhead and
underground utilities so it is not suitable as a building site for any new structures but it is potential
useable for surface parking and a landscaped area.
The city's Development Review Team determined that a plat of the property would establish the tract's
boundary, create a clear legal description of the property, provide easements to identify and protect
existing utilities and provide a method for giving an official name to the cul-de-sac created at the east
end of Wayne (Wayne Court). Because the city is the owner of the property and only a property owner
may initiate a plat application, staff is requesting City Commission authorization to plat the property.
The plat would first go to the Planning Commission for review and then to the City Commission to
accept the plat dedications.
Recommended Action
Approve the attached resolution authorizing the Engineering Department to prepare and file a plat of
the property and the Planning Department to prepare and file an application to give the property a
zoning designation to allow for future use of the property.
