The property that is the subject of this application is the South High School Campus located at 730 East Magnolia Road. BACKGROUND: Partially as a result of a request to erect a wireless communication tower in the Roselawn Cemetery on East Crawford, the Planning Commission authorized staff to draft a new Wireless Communication Facilities Ordinance to take the place of the existing ordinance which was adopted in 1998. In addition to requiring wireless communication providers to submit more detailed information about their existing network and future needs the new ordinance contains the following basic elements: . Does not cover amateur radio antennas, satellite dishes, or other types of towers and antennas. Those will be addressed separately. . Requires a pre-application conference with City officials. . Sets up of a 3 tiered permit system for wireless communication towers. - Class A Permits - Planning Director - Class B Permits - Planning Commission - Class C Permits - City Commission *Only the City Commission can grant waivers or exceptions to adopted standards. . Establishes locational preferences . Towers no longer a permitted use in A-1 zones. Special Use Permit required. . Applicants must provide an inventory of existing towers and an explanation as to why they can't co-locate their facilities on one of these towers. . No guyed towers are permitted. . Increases the required setback from residential areas. . Establishes design and appearance standards for new towers. Nature of Current Request Selective Site Consultants, Inc. has been searching for a suitable tower site in south Salina on behalf of Verizon Wireless for almost a year. The most immediate need is an additional tower and antenna array to help handle Verizon Wireless' volume of calls in south Salina. However, the applicant's plan is to construct a tower of suitable height and strength and in a suitable location to accommodate multiple users. Discussions between Selective Site Consultants and staff focused on the South High School campus where, due to the size and openness of the campus, staff believes a new tower would be less obtrusive than other possible locations in south Salina. Preliminary discussions with USD No. 305 have occurred regarding a possible lease of school district property at South High. Selective Site Consultants has filed this application for approval of a Special Permit to allow CITY OF SALINA REQUEST FOR CITY COMMISSION ACTION DATE 12/07/2009 TIME 4:00 P.M. AGENDA SECTION NO: ORIGINATING DEPARTMENT: APPROVED FOR AGENDA: 7 DEVELOPMENT SERVICES ITEM PLANNING NO. 4 BY: Page 3 BY: Dean Andrew construction of a 120 ft. high tower on a lease site located approximately 450 ft. south of Magnolia Road and 400 ft. west of the high school building. Specifically the site is on the east side of the football practice field I track which is located in a fenced in area on the west side of the campus. This field is not currently lighted but the proposed tower could serve as a light standard as part of a future field lighting project. The proposed tower would be a monopole tower and would be self-supporting and would not have guy wires. The applicant indicates that the proposed tower is capable of supporting more antennas for other co-locating users. The goal is to maximize the carrying capacity of this tower which results in a need for fewer individual tower structures. Because this proposed monopole tower is located in a residential zoning district (school site), it requires a Class C permit. Under the process set up in the Wireless Communication Facilities Ordinance, the Planning Commission must conduct a public hearing to review this request and forward its recommendation to the City Commission. The City Commission will make the final decision on this permit request. Applicable Zoninq Ordinance Requirements Installation of wireless communication facilities requires either an administrative permit (Class A Permit) issued by the Planning Director or approval of a special permit (Class B or Class C Permit) by the Planning Commission or City Commission. Class C Permit The City Commission may issue a special permit following a public hearing and recommendation by the Planning Commission in the following cases: -An application to construct a tower in a residential zoning district. This application involves a request to construct a tower on an R-1 zoned high school campus. Therefore it falls within the Class C Permit category which requires City Commission approval. Locational Preferences. Wireless communication facilities shall be located and designed to minimize any adverse effects on surrounding properties, particularly residential properties. In its review of requests for new tower construction the City of Salina will give preferred status to locations where the existing topography, surrounding land uses, existing buildings or other structures provide the greatest amount of visual screening. Proposed towers in sensitive areas will be discouraged. Preferred locations for new wireless communication facilities are listed below: (1) Preferred Location Sites: a. Publicly owned sites on which wireless communication facilities can be unobtrusively located with regard to visibility, aesthetic appearance and public safety. Such sites may include locating on existing buildings, light poles or water towers, co-locating on existing towers, screened roof-top facilities or other camouflaged sites for antennas CITY OF SALINA REQUEST FOR CITY COMMISSION ACTION DATE 12/07/2009 TIME 4:00 P.M. Page 4 DEVELOPMENT SERVICES PLANNING 4 BY: BY: Dean Andrew and recreation areas, athletic fields, school grounds, maintenance yards and other publicly owned facilities for towers. b. Privately owned sites which possess the same characteristics as a. above. c. Sites in commercially or industrial zoned districts where wireless communication facilities would be minimally obtrusive, would have a minimal impact on the surrounding area, are an appropriate distance from residential areas. (2) Limited Preference Sites: a. Sites on other public property. b. Sites on other commercially or industrially zoned property. (3) Sensitive Location Sites. Sites located in areas with predominantly residential uses, environmentally sensitive areas, entryway corridors to the City, local landmarks or historic district, properties listed or eligible to be listed on the National Register of Historic Places and the environs of the Salina Municipal Airport. Performance standards. Unless otherwise specified, all wireless communication facilities shall comply with the following performance standards. The Planning Commission may recommend and the City Commission may grant a waiver from these standards when supported by sufficient justification and if the purpose and objectives of this section would be better served thereby. (1) Height. The maximum height for a communications tower is 200 feet, excluding a lightning rod not to exceed 20 ft. All new towers in excess of 100 feet shall be designed to accommodate at least 2 providers and in excess of 150 feet at least 3 providers. (2) Design type. All towers shall be a monopole design unless specifically approved to be otherwise by the City Commission. Guyed towers shall not be permitted. (3) Setbacks. Towers shall be set back from any property line or a public right-of-way a distance equal to the tower height. (4) Facility Appearance. a. Towers shall either maintain a galvanized steel finish or, subject to any applicable standards of the FAA, be painted a neutral color to reduce visual obtrusiveness and so as to be consistent with the natural or built environment of the site. b. The design of the equipment structure and any other associated permitted structures shall, to the maximum extent practicable, use materials, colors, textures, screening, and landscaping that minimize the visual impact and enhance compatibility with the surrounding natural or built environment. c. For co-located telecommunications facilities, the antenna and supporting electrical and mechanical equipment must be of neutral color that is identical to, or closely compatible with, the color or the supporting structure to minimize CITY OF SALINA REQUEST FOR CITY COMMISSION ACTION DATE 12/07/2009 TIME 4:00 P.M. No signals, artificial lights, or illumination shall be permitted on any Facility unless required by the FAA or other applicable authority. Security lighting around the base of the tower may be provided if the lighting is shielded so that no light is director towards adjacent properties or rights-of-way. (6) Security Fencing. Towers and associated accessory building/equipment shall be enclosed by a security fence or wall that is a minimum of six (6) feet in height and is equipped with an anti-climbing device or apparatus. Additional measures may be required as a condition of the issuance of an administrative permit as deemed necessary by the Planning Director or Planning Commission or the City Commission in the case of a special permit so long as the additional measures are reasonably related to a security issue. (7) Outdoor Storage. No outdoor storage of vehicles, materials, or equipment IS permitted. (8) Signs. No signs, including commercial advertising, logo, political signs, flyers, flags, or banners, but excluding warning signs, shall be allowed on any part of tower or antenna site. a. "NO TRESPASSING" warning signs shall be permanently attached to the fence or wall surrounding the structure and spaced no more than 40 feet apart; the height of the lettering of the warning signs shall be at least 12 inches and the signs shall be installed at least 5 feet above the finished grade; the warning signs may be attached to free standing poles if the content of the sign may be obstructed by landscaping. b. A sign on the gate indicating the name and address of the tower owner and a phone number where the tower owner can be reached 24 hours a day in case of an emergency. (9) Parking. Each facility site shall provide paved parking for use by maintenance personnel. (10) Landscaping. Facilities must comply with all applicable landscaping requirements of the Zoning Ordinance. At a minimum the landscaping shall consist of a landscape strip of not less than 10 feet in width planted with materials which will provide a visual barrier to an minimum height of 6 feet, as approved by the City. The landscape strip shall be exterior to any security fence or wall. Standards for Evaluation of Special Permit Applications (1)The Planning Commission or City Commission may approve, by special permit, a wireless communication facility in any zoning district after review and consideration of all CITY OF SALINA REQUEST FOR CITY COMMISSION ACTION DATE 12/07/2009 TIME 4:00 P.M. Conformity with the city's Comprehensive Plan. 2. Preference of site location in accordance with Subsection (d). 3. Compatibility with abutting property and surrounding land uses. 4. Adverse impacts such as visual, environmental or safety impacts. 5. Color and finish of the proposed tower. 6. Screening potential of existing vegetation, structures and topographic features. 7. Potential for adequate screening of proposed facilities, ground level equipment, and tower base. 8. Scale of facility in relation to surrounding land uses. 9. Impact on entry corridors into the city. 10. Impact on landmark structures/historically significant structures or districts or architecturally significant structures. (2)An application to construct new towers may be denied if the applicant has not shown by substantial evidence that it has made a good faith effort to mount the facilities on an existing structure and/or tower. Planninq Commission Recommendation The Planning Commission conducted a public hearing on this tower permit application on November 17, 2009. The proposed tower site is one of the preferred location sites (school grounds / athletic fields) under the City's ordinance and the proposed tower structure is being built to serve a dual purpose - lighting standard and communication tower, for those reasons the Planning Commission voted 5-0 to recommend approval of Selective Site Consultants' application for a Class C Permit to construct a new 120 ft. tower on the South High School campus subject to the following conditions: 1. Construction of the tower and equipment shelter shall substantially conform with the site plan, elevation drawings and associated submittals on file with the Planning Department which are herein incorporated into the perm it by reference. 2. Landscaping which provides sight obscuring screening to a height of 6 ft. shall be planted outside the fenced in area adjacent to the tower location unless a waiver of the landscaping requirement is granted by the City Commission. COMMISSION ACTION: Staff has identified the following alternatives for the City Commission consideration: 1. If after reviewing the standards in Section 42-69.7 of the Wireless Communication Facilities Ordinance (see page 6) the City Commission concurs with the recommendation of the Planning Commission, a motion should be made to approve the Special Permit as requested with or without the recommended condition regarding landscaping around the base of the tower. Alltel serves Salina through its five sites in the city; utilizing six of the eight channels licensed to it. Of the two remaining channels, one will be used to mitigate data performance degradation and the other is reserved for roaming (GSM). By the end of December 2010, the system is expected to suffer severe performance degradation due to continuous increase in traffic usage (please see attached maps). With all of the channels being used, Verizon Wireless is left vulnerable to natural traffic growth, unexpected voice traffic pattern changes and unexpected data traffic pattern changes. This will result in elevated blocked calls, dropped calls, ineffective attempts and slow data throughput. Having used up all of the available channels, the only solution left is to build two (2) new sites that will offload the surrounding cell sites. The attached RF predictions depict present coverage quality in and around Salina, predicted coverage quality in 2010 without Salina sites #7 and #8. The attached prediction also documents technical deficiencies ifVerizon Wireless were to collocate on an existing tower in lieu of construction of a new pole for site Salina #7, in furtherance of Salina Municipal Code Section 42- 69(f)(5). In conjunction with Alltel's request that SSC find a suitable location for a wireless facility in Salina, Alltel and/or its associated business partners issued a "search ring" which is attached hereto as Exhibit "A". 6. The search ring identifies Alltel's preferred geographic location for the placement of a new wireless facility, taking in to account Alltel's network design, infrastructure and area topography. 7. The search ring is generally centered on real property owned by Unified School District Number 305 at 730 East Magnolia Street, in Salina. 8. The radius of the search ring is approximately one-fourth (1/4) mile, and the diameter of the search ring is approximately one-half (1/2) mile in width. 9. In accordance with the policies of Alltel that require site acquisition personnel to look first for potential collocation opportunities within a given search area before attempting to find areas where a new tower will be required, and to meet the requirements of Section 42-69(f)(1) and (2) of the City of Salina Municipal Code, SSC has driven the area within a one (1) mile radius of the proposed site to determine if there were any available structures that would meet the Alltel's Radio Frequency Engineer's requested needs. 10. Based upon the field observations of SSC's site acquisition team, there are no existing tower or other structures within one (1) mile of Alltel's proposed search ring coordinate center. 11. Because no structures exist within the search ring, Alltel proposes to construct a new tapered tubular steel light standard replacement on the USD 305 property that will accommodate Alltel's antennas at the antenna centerline required to meet Allte!'s network objectives. The Facility will be located within the confines of property owned by the Unified School District No. 305 and situated at 730 East Magnolia Road, Salina, Kansas. This parcel is located within an area zoned as R1 Residential. 3. This Affidavit is submitted for the purpose of demonstrating compliance with the provisions of Sections 42-69(e)(2) and 42-69(f) of the Salina Municipal Code, which govern wireless communications facilities. 4. Verizon Wireless affirms that the Facility will meet or exceed any requirements of the Federal Aviation Administration ("FAA") and the Federal Communications Commission ("FCC") as well as all other federal, state, and local laws and regulations applicable to the telecommunications industry. Verizon Wireless will also assure that the Facility complies with all applicable state and local building and electrical codes. 5. No strobe lighting will be placed on the light standard unless specifically required by the FAA or other governmental agency. Any lighting placed on the light standard will meet minimum requirements imposed by the FAA. Security lighting for the equipment compound, if necessary, will be down shielded to keep light from affecting any adjoining residential properties and city streets. 6. Verizon Wireless adheres to a policy of collocation on all of its tower facilities where feasible. The proposed light standard at this location will be a tapered tubular steel tower structure which will be designed with sufficient height and strength to accommodate one (1) additional service provider. The wrought iron fence will be integrated into future plans the school district has for the stadium. He stated that he felt this was a win I win situation for Verizon and USD #305. Mr. Mikesell asked if the tower would require flashing lights to alert aircraft? Mr, Wood stated that they would have to file a FAA application to be sure, but he does not anticipate the need for flashing lights, Mr, Andrew asked if the equipment shelter would be enclosed by a fence? Mr. Kennedy stated that the equipment shelter will not be enclosed by the fence, but the tower will be. This design will allow for and match future improvements. Dr, Hodges asked how high the tower would be? Mr. Wood stated 130 ft, tall. Dr, Hodges asked how tall the stadium lights are currently? Mr. Kennedy stated 85 ft. and 100 ft. Glen Skulborstad, 2524 Edward, asked what's a child's life worth? Because the cell tower will be taller than the current stadium lights, it will attract more lightening, endangering the lives of children. Mr, Wood stated that Verizon Wireless maintains liability insurance and the tower will have significant grounding to stop the spread of electricity should a lightening strike occur as well as a lightening rod, Mr. Andrew stated that the method of prevention (the grounding of the tower) is more important to staff than liability insurance. The November 17, 2009 Page 4 of 6 subject property is the athletic field on the west side of the South High School campus which is addressed as 730 East Magnolia Road. Mr. Andrew presented the staff report with visual graphics which are contained in the case file. Mr. Wood stated that this will be a shorter pole, 115 ft., and it will be inside a wrought iron fence. There are no lights currently at the stadium, but the tower will allow for the addition of lights when the school district decides to install lights there. They located the pole in a logical place for a light support and as far away as possible from surrounding residences. Glenn Skulborstad, 2524 Edward, stated that as a former track coach at South High, he knows that the static electricity in that stadium is already bad due to the proximity of power lines and the water tower. He feels that someone has to stand up for the children. Mr. Andrew stated that the National Electrical Code requires that structures like these be grounded at the base. Mr. Kennedy stated that the school district provides coaches with devices that alert them when lightening is coming close. Mr. Wood stated that the City declined Verizon Wireless' request to put cellular antennas on a water tower. Mr. Andrew state that it is the City of Salina's policy not to allow cellular equipment on water towers. It is a liability issue for the City to have people who are not working for the City accessing water towers.
