Stack ITEM: Consideration of an engineering design agreement with RMA Engineering, LLC (RMA) for street and stormwater improvement construction plans for the intersection of Marymount Road and Glen Avenue, City Project No. 08-2712. BACKGROUND: City staff is currently working on plans to re move and replace aged and rough pavement on Marymount Road between Iron Avenue and Crawford Street as well as options to realign and add a sidewalk on the west side. The intersection of Marymount Road and Gl en Avenue is an area identified as having inadequate drainage and will need a more in depth design to complete the plans for these improvements. RMA is a small engineering firm bas ed out of Minneapolis, Kansas specializing in urban storm drainage. The scope of work outlined in the agreement with RMA includes looking at two options to alleviate street flooding on Marymount as well as design and construction bid plans to improve the Glen intersection and “sump” area just south of Ruskin Road. The contract with RMA is written in a “cost plus fixed fee” forma t with an amount not to exceed $23,400. The “cost” includes all direct payroll, direct non-payroll and overhead (indirect costs). The “fixed fee” is a lump sum amount to cover any non-reimbursable costs, pre-tax profit and readiness to serve. The fixed fee does not change regardless of variations in “cost.” The “cost not to exceed” is a total amount that cannot be exceeded without prior approval. The attached contract also addresses the scope of work, consultant’s re sponsibilities, City’s responsibilities, time schedule, and general provisions. FISCAL NOTE: This project will be paid for by flood and drainage funds allocated in the 2009 sub-CIP. COMFORMANCE WITH STRATEGIC PLAN: Goal 3: The City will provide the highest quality of services, consistent with governing body direction, available resources and staff commitment to quality. RECOMMENDED ACTION: Staff recommends approval of an Engineering Agreement with RMA for an amount not to exceed $23,400 for street and stormwater improvement construction plans for the intersection of Marymount Road and Glen Avenue, City Project No. 08-2712.
