BACKGROUND On October 20, 1997, the City Commission approved a petition, engineering feasibility report and resolution of advisability for street, drainage, water and sanitary sewer system improvements in Golden Eagle Estates. Golden Eagle Estates is a residential subdivision located north of Magnolia Road and east of Huntington Road. The attached petition was submitted by Mr. Dan Meinhardt on March 11, 1999, requesting street, drainage, and utility improvements to expand the benefit district to include Lot 26, Block 5 and Lot 4, Block 4, Golden Eagle Estates. The original petition in 1997 did not include Lot 26, Block 5 or Lot 4, Block 4, Golden Eagle Estates as part of the benefit district. Please see attached map. After the original petition for public improvements was submitted and approved by the City Commission, the design plans were revised to include Lot 26, Block 5 and Lot 4, Block 4, Golden Eagle Estates as part of the benefit district. These changes were not communicated to staff and missed during the approval of final plans for bidding. These improvements were completed in 1998 as part of the 1997 Subdivision Improvements, Project No. 97-1072. Attached to the next item of the agenda is an amended resolution of advisability and authorization for this project. This resolution will allow these lots to be added to the benefit district and included in the final special assessment ordinance for Phase II of the Golden Eagle Estates public improvements. In accordance with Kansas State Statutes and advice from our bond counsel, affected property owners are entitled to a public hearing and protest period. In order to keep on schedule with the final 1999 special assessment ordinance, the property owners have signed a waiver agreeing to waive their right to a public hearing and any protest to the inclusion of these lots in the benefit district: RECOMMENDATION No action required at this time. However, the next item on the agenda includes the resolution in question.
