Page 1 5 BY: Dean Andrew BY: ITEM: Acceptance of public utility and drainage easements dedications In Block 1 of the Replat of the Country Oak Estates Subdivision. BACKGROUND: On May 15, 2007 the Salina City Planning Commission reviewed and approved a final development plan for a Comfort Suites hotel that was proposed to be constructed on a portion of Lot 3, Block 1 of the Country Oak Estates Subdivision located at the southwest corner of Schilling Road and 1-135. The proposed development plan subdivided Lot 3 (which is located south of the Super 8 Motel and Casey's) into two building lots with a shared access drive connecting the site to Schilling Road and Marcella Drive. The Planning Commission approved the proposed site development plan subject to 14 conditions. Two of these conditions related to the need for the owner / developer to dedicate utility easements for 6" public water lines that were extended to provide domestic service and fire protection for the 3 story hotel and the need to dedicate a drainage easement for the detention basin located south of the parking lot. Because a portion of the proposed drainage easement overlapped a 66 ft. easement held by Kansas Gas Service, the developer requested and received approval from Kansas Gas to utilize a portion of their easement. A copy of the approval letter is attached. The required public easements have been legally described and executed by the owner / developer and are now ready for the City Commission's acceptance. RECOMMENDED ACTION: Accept the offered utility and drainage easement dedications for public water lines and the detention basin serving the Comfort Suites Hotel site in the Replat of the Country Oak Estates Subdivision. Di1ip Patel 785-478-6851 785-544-1044 RE: Comfort Suites Hotel Lot 3 Block 1 Country Oaks Estates Addition Dear Mr. Patel I am writing with regard to the development ofthe new Comfort Suites Hotel Located in the County Oaks Estates Addition Block 1 Lot 1 and the request for the Encroachment within our pipeline easement. The pipeline, which cross through this Easement is an 8-inch welded, high-pressure line. Our pipeline right-of -way grants Restrict development of structures near our pipeline. Due to concerns about leakage and Migration of gas, we do not approve hard surfacing (such as a parking lot) over our Pipelines. Kansas Gas Service shall have the right to clear and keep clear brush, trees, shrubbery, roots, buildings and other obstructions which in judgment, may interfere with the safe, proper and expeditious laying, construction, maintenance, alteration, inspection, repair, replacement, protection, relocation, operation and removal of said pipe line, lines and facilities, or any part thereof, the easement. You had mentioned the possibility of a water line crossing this easement. The water line will need to be a 24" clearance below our pipeline and Kansas Gas Service will want to inspect both before the ditch is backfilled. It is not our intent to restrict development, but we have to view encroachments in Light of what effect they will have on; the safety and operation of our pipeline.
