Second reading Ordinance Number 99-9918 ordering the condemnation and acquisition of a permanent easement
for the use of the City of Salina, Kansas, for the purpose of storm drainage detention and temporary storage,
pursuant to K.S.A. Chapter 26, and amendments thereto, as it relates to condemnation by cities, and further
pursuant to Resolution Number 99-5419 of the City of Salina, Kansas.
Backaround
The ordinance as proposed for adoption on second reading includes two modifications. Section 5 regarding the
indemnification provision to be included in the petition has been expanded to include liability for federal/state
orders relating to environmental impacts of the storm drainage detention or storage. Section 7 regarding the
designation of a benefit district has been expanded to include an 8.54 acre tract adjacent to Eastview Estates
Addition. The additional tract is under the same ownership as Eastview Estates Addition.
Recommendation
Adopt Ordinance Number 99-9918 on second reading.
