Report on validity and submittal of engineering feasibility report for Petition No. 4233 filed on
August 1, 2002 by Mr. Darvin Dent requesting certain street and drainage improvements in
Woodland Hills Estates Addition, Phase 4.
BACKGROUND:
It is prescribed by Kansas state statutes that the City Commission consider a petition for
street, drainage or utility improvements and establish sufficiency on the basis that anyone
of the following three conditions are met:
1. The petition is signed by a majority of the resident owners of record of property
liable for assessment under the proposal.
The petition is signed by the resident owners of record of more than half of the
area liable for assessment under the proposal.
The petition is signed by the owners of record, whether resident or not, of more
than one half of the area liable to be assessed under the proposal.

In this case, the petition signatures represent 100% of the owners of record of the area liable
for assessments. Therefore, the petition clearly meets the statute requirements for
sufficiency. The Saline County Treasurer has indicated there are no delinquent taxes or
special assessments on any property within the benefit district owned by the petitioners.
Woodland Hills Estates Addition is a single family residential subdivision located in the
northeast part of Salina. The project represents the fourth phase of the subdivision. There
are essentially four parts to this project: 1) paving of Brookwood Lane, 2) paving of Estates
Drive, 3) sewer and water systems and 4) Brookwood Lane drainage crossing. The paving
of Estates Drive and the sewer and water systems are being contracted and funded privately
in conjunction with these petitioned improvements. Therefore, the only items that the
developer is requesting public financing for are the paving of Brookwood Lane and the
Brookwood Lane drainage crossing.
The City of Salina has a program where any owner may petition the city-at-Iarge to pay 50%
for any public improvement that serves a significant quantity of off-site public drainage. The
Brookwood Lane drainage crossing does serve a large basin that extends south to include
part of the Salina Municipal Golf Course, and therefore qualifies for the 50% funding by the
city-at-Iarge.

Purposely excluded from the benefit district is a portion of Salina Presbyterian Manor that is
adjacent to Brookwood Lane. This property is bisected by a public drainage easement, and
therefore is not of sufficient lot depth for a buildable lot. Therefore, this property does not
receive a benefit from these improvements and was omitted from the benefit district. This
property was omitted from the benefit district with the understanding that the equivalent
residential lot cost for this property would be paid by the city-at-Iarge.
The engineering feasibility report for these public improvements is attached for your review.
The property owners within the benefit district shall be assessed for approximately 80.5% of
the Brookwood Lane project costs and 40.2% of the Brookwood Lane drainage crossing,
which are estimated to cost $39,189.36 and $14,088.20 respectively for a total of
$53,277.56. Each lot within the benefit district will pay their share of the costs based upon
an equal assessment per lot. The City's estimated share of the project is $30,448.54
The benefit district's portion of project costs will be financed over a 15 year period with the
special assessment system. The petitioner has the option of submitting a letter of credit for
35% of the project costs and assessing 100% of the project costs to the property owners, or
pay 20% of the project costs in cash in advance ond then assess the remaining 80% to the
benefit district.
RECOMMENDATION:
It is recommended that the City Commission approve the engineering feasibility report for
street and drainage improvements in Woodland Hills Estates Addition, Phase 4, and adopt
the resolution determining advisability for the project.

ADOPTION OF A SESSMENT
The assessment with accrued interest to be levied as a special assessment tax upon the
property included within the benefit district concurrent with the general property tax and
shall be payable in fifteen(15) equal annual installm.ents.
The method of assessment is that 100% of the total cost assessed against the property
shall be basèd upon equal assessments for each equivalent residential lot in the benefit
district relative to the type of improvement and the sub-area affected by each
improvement.

APPORTIONMENT OF COST
COST CHARGEABLE TO PRIVATE PROPERTY:

Approximately 80.5% of the total cost of street and drainage improvements,
including grading, pavement, curbs and gutters, storm inlets and any incidentals
thereto to complete the residential street standard and drainage systems or 100%
less (-) the amount (19.5%) that would be attributable to the tract on the south
side ofBrookwood Lane had this tract been included in the benefit district. **
2. 50% of the total cost of the drainage channel crossing under Brookwood Lane
including culverts, earthwork, erosion control, and grading; less (-) the amount
that would be assessed to the tract on the south side ofBrookwood Lane (9.77%)
for atotal of 40.23%. **
COST CHARGEABLE TO CITY:
1. 50% of the total cost of the drainage channel crossing under Brookwood Lane
including culverts, earthwork, erosion control and grading; plus (+) the amount
that would be assessed to the tract on the south side ofBrookwood Lane (9.77%)
for a total of 59.77%.**

Approximately 19.5% of the total cost of street and drainage improvements
including grading, pavement, curbs and gutters, storm inlets and any incidentals
thereto to complete the residential street standard and drainage systems or the
amount that would be attributable to the tract on the south side ofBrookwood
Lane had this tract been included in the benefit district. * *
**Due to findings by the City of Salina that the tract on the south side of
Brookwood Lane is bisected by a major drainage channel and easement that serves
off-site properties, this tract is deemed undevelopable. As a result, this property
receives no benefit fÌ'om these improvements, and was therefore excluded fÌ'om the
benefit district. The city-at-Iarge will pay the appropriate equivalent lot costs for
this tract for the Brookwood Lane drainage crossing and the Brookwood Lane street
construction.
