Petition No..3937 filed by Gary Wagner, for certain storm sewer improvements in Replat
of Faith Addition, was referred to the Engineering Department for a recommendation on
June 8, 1987.
Kansas statutes state the City Commission may find a petition for street, utility, etc.
improvements sufficient if it is signed by enough owners to fulfill any one of these
three (3) requirements, (i) a majority of the resident owners of record of property
liable for assessment under the proposal, or (ii) the resident owners of record of more
than one half of the area liable for assessment under the proposal, or (iii) the owners
of record (whether resident or not) of more than one half of the area liable to be
assessed under the proposal.
The petition signers represent the owners of 50% of the area liable for assessments
(within the benefit district) and 59% of the resident owners. Therefore, the petition
meets the Kansas statute requirement and the requirement of Resolution No. 84-3750 for
a sufficient petition. The records of the Saline County Treasurer indicate there are
no delinquent taxes and special assessments on any property within the benefit district.

We are filing a feasibility report for the above requested improvements and recommend
the City Commission pass a resolution determining the advisability of this project.
The property owners within the benefit district shall be assessed 100% of the project
costs.
The total cost of this project is estimated to be $7,417.50, all of which would be
financed by the City and paid over a 10 year period by the property owners within the
benefit district.

SCOPE OF WORK
The installation of a storm drainage pipe along the south line of Lot 10,
Block 3, Replat of Faith Addition, connecting an inlet to be installed at
the SW corner-of Lot 10, Block 3, and an existing curb inlet at the SE
corner of Lot 10, Block 3; and the grading of the north-south utility
easement at the rear of Blocks 3 and 7 to provide drainage to the inlet at
the SW corner of Lot 10, Block 3.
BENEFIT DISTRICT
Lots l, 2, 3, 4, 5, 9, 10, ll, 12 and 13, Block 3; and Lots 2, 3, 4, 5, 6,
7, 8, 9, l0 and ll, Block 7, Replat of Faith Addition to the City of
Salina, Kansas.
ADOPTION OF ASSESSMENT
The assessment with accrued interest to be levied as a special assessment
tax upon the property included within the benefit district concurrent with
the general property tax and shall be payable in ten (10} equal annual
installments.
The method of assessment-shall~ be based on the adjusted front footage of
each lot of land and without regard to buildings orimprovement of the land.
APPORTIONMENT OF COST

1. 100% of the total cost of storm sewer pipe, inletS, trenching, back-
filling, grading and any incidentals thereto to complete the drainage
system.
