Consideration of a third supplemental agreement with Wilson and Company for additional design and
construction services for Phase IV of South Ninth Street, Project No. 06-1579.
BACKGROUND:
This project continues the effort to improve Sout h Ninth Street from Broad way Boulevard to Water
Well Road, which began in the mid-1990’s. Phase I (Cloud Street to Otto Street) was constructed by
Shears, Inc. in 1996, Phase II (Otto Street to M agnolia Road) by Smoky Hill in 1998, Phase III
(Magnolia Road to south of Belmont Boulevard) by Smoky Hill in 2002. Phase V, which extends the
south limits of this project to Water Well Road is estimated to cost $5,000,000 in 2009 dollars and is
projected to be built around 2015.
Phase IV generally includes the replacement of South Ninth Street from approximately 400 feet south
of Belmont Boulevard to approximately 150 feet south of Riffel Drive and other geometric and signal
improvements. Bids were received for this phase on February 24, 2009, and the project was
awarded to Smoky Hill, LLC for just over $4.6 m illion the following Monday. Smoky Hill intends to
begin the project in June or July of this year, recess for the ho liday season, then complete the
construction the next construction season. An associated landscaping/art project will likely be let for
bids in the fall/winter of 2009/2010 and should be built c oncurrently with this project in the spring or
fall of 2010.
Wilson & Company performed surv eying, mapping, and conceptual design under the original
agreement dated February 6, 2006. The first suppl ement to that agreement dated April 16, 2007,
covers the preliminary and final design of the improvements. The second supplement dated October
20, 2008 covers the design of an additional signal at Riffel Drive, the design of a pedestrian/bicycle
path north of Schilling Road from South Ninth Street to South Ohio Street, and accommodating the
City’s adding an art element late in the project’s development.
Five items have been or are being asked of the consultant, which were neither planned for nor
foreseeable when the project began:
1. Analyze traffic at the new Kohl’s entranc e to ensure the entrance functions efficiently.
2. Design additional plan sheets and details per request of City sta ff to include erosion control,
summary of quantities, plan changes to eliminate Westar facility relocation, pavement, and extra
bid items.
3. Design a 5’ sidewalk on the we st side of 9th Street from south of Riffel Drive to Schilling Road and
a 10’ pedestrian/bicycle path on the east side of 9th Street from the south of Riffel Drive to
Belmont Boulevard.

4. Redesign the Tuscon’s/Del’s/Country Inn and Suites intersection due to the City’s decision to
cease right of way acquisition for the continuation of Market Place east of South Ninth Street.
5. Create a formal drainage report for the South Ninth Street project to aid in guiding development
along the corridor particularly south of Riffel Drive.
Items 3 and 4 would best facilitate the upcoming cons truction if they were started and completed as
soon as possible.
FISCAL NOTE:
The 2009 Capital Improvement Program includes selling bonds to finance $6,500,000 for Phase IV of
South Ninth Street, which includes the consul tant design fee ($537,444 actual), consultant
construction services ($50,000 estimated), ri ght-of-way and easement acquisition ($130,000
estimated), utility relocations ($100,000 estimated), testing ($25,000), construction of this project,
construction of the forthcoming art and landscaping project ($400,000 estimated), temporary interest
costs ($200,000 estimated), and closing/issuance costs ($60,000 estimated). Award of this project as
proposed brings the total project cost to an estimated $6,242,414.29.
The consultant fee being requested fits within the estimated $50,000 for consultant construction
services listed above.
COMFORMANCE WITH STRATEGIC PLAN:
Goal 3: The City will provide the highest quality of services, consistent with governing body direction,
available resources and staff commitment to quality.
RECOMMENDED ACTION:
Staff recommends that the City Commission approve the supplemental agreement with Wilson and
Company for Phase IV of South Ninth Street, Project No. 06-1579, in the amount of $47,610.00.
