Page 1 BY: ITEM: Ordinance No. 09-10500 Application #PDD 09-1, filed by Steve Snyder, Director of Parks and Recreation on behalf of the City of Salina, requesting change in zoning district classification from R-1 (Single-Family Residential) District to Planned Development District with underlying zoning of R-1 (Single-Family Residential) with some modifications. The subject property is a 5.92 acre tract of land located south of the Bicentennial Center in the Kenwood Park Addition to the City of Salina, Saline County, Kansas which is addressed as 701 West Kenwood Park Drive. BACKGROUND: In 1917 the City of Salina acquired approximately 65 acres inside a bend of the Smoky Hill River for $30,000. This property was platted a year later as the Kenwood Park Addition to the City of Salina. The plat has remained unchanged since that time. In 1929 the City entered into a lease agreement with Saline County that allowed the County to establish and maintain a County owned and operated free fair in the park. The City reserved the right to continue to use the park area for public park purposes at all times except when that use would conflict with the use of the park by the County to operate its fair. The agreement also stated that buildings built by the County would remain the property of the County and buildings built by the City would remain the property of the City. This agreement was renewed and revised in 1959 and amended in 1977 to allow construction of the Bicentennial Center and again in 1988 to allow construction of a City Recreation Center which was never built. The 1988 Addendum to the Kenwood Park Lease Agreement expired and a new renewable lease with the County was negotiated in March of 2009. The existing public facilities in Kenwood Park are: - Ag Hall - built in 1924 - Rodeo Grounds (former Blue Jay Stadium) - built in 1931 - 4-H Building - built in 1969 - Municipal Swimming Pool - built in 1956 - Bicentennial Center - built in 1977 The swimming pool and Bicentennial Center are City owned facilities. The Rodeo Grounds, livestock barns, Ag Hall and 4-H building are County owned facilities. Historically the city's parks have been zoned R-1 (Single-Family Residential) to indicate that parks are an extension of the surrounding residential neighborhoods. Oakdale, Sunset, and Jerry Ivey Parks are all zoned R-1 and those are passive parks rather than having large activity centers or recreational facilities. Kenwood Park was also historically zoned R-1. In 1978, while the Bicentennial Center was under construction, the City Commission agreed to authorize the sale of cereal malt beverages and other alcoholic beverages at the Bicentennial Center. In order to receive and hold a CMB or drinking establishment license a facility must be in a zoning district that permits drinking establishments. The R-1 district does not permit such establishments. Therefore, the Planning Commission initiated the rezoning of the Bicentennial Center and fairground site from R-1 to C-3 which does permit drinking establishments. In March of 1979 approximately 57 acres of Kenwood Park was rezoned to C-3 to cover all the buildings and areas that might have the sale of beer and consumption of alcoholic beverages. The athletic field south of the Bicentennial Center which was being used by USD #305 was not included in the rezoning and remained zoned R-1. Planning BY: Dean Andrew BY: Nature of Request Because of the intensity of use and the traffic and activity involved compared to a neighborhood or community park, swim clubs and YMCA-type recreation facilities are a conditional use in the R-1 district which must be reviewed and approved by the Planning Commission on a case by case, location by location basis. However, after staff received the design plans for the proposed Aquatic Center facility, Planning staff determined that there were some unique design and layout aspects of the facility that didn't fit within the parameters of the R-1 zoning district, the Conditional Use Permit process or really any standard zoning district in the city. In addition, there are a number of existing utility lines that need to be relocated to accommodate the Aquatic Center project and this created new utility line alignments and a need to provide easements for the new lines to more clearly identify and protect those utility lines. Planning staff recommended that the Planned Development District process be used to address these design and layout issues. The Director of Parks and Recreation then filed this application to change the zoning classification of the proposed Aquatic Center site from R-1 (Single-Family Residential) to PDD (Planned Development District). The PDD process allows the Planning Commission and City Commission to create a customized zoning district for a proposed development including limitations on and the addition of uses as well as modified lot size, setback, parking, and landscaping requirements as well as bulk and density limitations. Modifications of Zoninq Ordinance Requirements Beinq Requested 1) A reduction of the required front yard setback along Kenwood Park Drive from 25 ft. (the minimum front yard setback required in the R-1 district) to 9 ft. to allow two (2) inner tube storage structures to be located within 9 ft. of the west (Kenwood Park Drive) property line. The slide tubes for the water slide would be located within 19 ft. of the west property line. 2) A variance to the 35 ft. maximum structure height limit in the R-1 district to allow a proposed roof covering a stair tower platform for the water slides that would be 48 ft. in height. 3) A reduction in the required amount of "on-site" parking from 390 spaces to 5 handicapped accessible spaces and acceptance of the current shared parking arrangement for the Bicentennial Center, Aquatic Center and County fairgrounds facilities. Page 3 BY: 4) A variance to the 32 sq. ft. size limit for identification signs in the R-1 district to allow a 60 sq. ft. monument sign in the southwest corner of the site. 5) An exception to Section 42-63(a) of the Zoning Ordinance which prohibits structures from being built within public utility easements to allow portions of a concession stand arbor and inner tube storage structure to be located within projected sanitary sewer and storm sewer easements. Review of Preliminary Development Plan for the Aquatic Center Site Coveraqe Total Land Area = 5.92 acres Proposed Building Area = 9,530 sq. ft. Total Lot Coverage = Approximately 4% R-1 maximum = 35% Building Orientation - The front entryway into the facility would be oriented to face east toward the Bicentennial Center parking lot and the 4H building. This would be the only public entrance into the facility. Proposed Structure Height = 48 ft. (Height of roof over stair tower platform) R-1 maximum = 35 ft. Buildinq Setbacks - Planning staff has interpreted this site to have two front yards (west and south) and two side yards (north and east) with the curb line of the Bicentennial Center parking lot forming the east property line. The required setbacks for conditional uses in the R-1 district (churches, schools, recreational facilities, etc.) are 25 ft. from a front property line and 25 ft. from any side property line. All proposed improvements on the Aquatic Center site would comply with these setback requirements with the exception of two (2) inner tube storage structures which would be located 9 ft. from the west (Kenwood Park Drive) property line and the tubes leading to the proposed plunge pool which would be located 19 ft. from the west property line. These structures are relatively open structures and the visual impact of them being closer than 25 ft. from the west property line should be minimal and will be further reduced by proposed fencing and landscaping around the perimeter of the Aquatic Center. * Staff would note that as shown on the applicant's site plan portions of the proposed wrought iron fence would encroach on the Kenwood Park Drive right-of-way and the fence location needs to be adjusted to conform to the surveyed property line. Off-Street Parkinq - Because this is a replacement and expansion of the existing municipal pool which CITY OF SALINA REQUEST FOR CITY COMMISSION ACTION DATE 05/18/09 TIME 4:00 P.M. Page 4 is pre-existing nonconforming as to off-street parking, the applicant is required to provide parking for the new aquatic facility based on the expanded parking need (difference between existing and proposed). Based on a projected maximum occupant load of 1980 persons, this facility would need to have 660 off-street parking spaces, 13 of which would need to be handicapped accessible spaces, if it were built as a new freestanding use. In this case, the new pool would be a 33% expansion of the size of the existing pool in Kenwood Park which reduces the off-street parking requirement to 370 parking spaces, 8 of which would need to be handicapped accessible spaces. Planning BY: Dean Andrew BY: Presently there are 246 parking spaces in the paved parking area east of the proposed Aquatic Center site and 488 parking spaces in the paved parking area between the proposed Aquatic Center and the Bicentennial Center. There are a total of 1189 off-street parking spaces on the Bicentennial Center Campus and 10 off-street spaces under the control of the County north of Ag Hall and the 4-H Building. This is well under the number of spaces that would be required if these facilities had been built today. Approximately 2,000 would be needed for the Bicentennial Center arena alone if it were built today. The 734 parking spaces within 600 ft. of the proposed aquatic center site are more than adequate to meet the needs of the proposed water park facility. The parking issue or question becomes those weekdays or weekends when multiple facilities in Kenwood Park are in use at the same time. The city's off-street parking regulations make provision for joint use or shared parking arrangements but the language in Section 42-552 ( e) 7. reads as follows: "Collective and joint use provisions. One (1) off-street parking area may serve several different uses provided the area contains the total required spaces for all uses. In addition, different uses may make joint use of the same parking spaces provided written assurances are given that such uses operate at different or nonconflicting times. All regulations covering the location of accessory parking spaces in relation to the uses served shall be adhered to." The classic example is a medical office and church that share the same parking lot with the office using it weekdays 8:00 - 5:00 and the church using the same lot Wednesday evenings and Sunday mornings. There is no overlap or conflict. It is not possible to say that the Aquatic Center and Bicentennial Center or the Aquatic Center and other fairground facilities will never be in use at the same time. However, there is a 30 year track record of shared use of the Bicentennial Center parking lots and the current configuration has seemed to work and to have been acceptable over that period of time. The applicant is requesting that the City Commission accept and approve the current parking arrangement in Kenwood Park and to not require that an additional 370 parking spaces over and above the existing parking be constructed to serve the new Aquatic Center. The plan does show five (5) new handicapped accessible spaces on the Aquatic Center site itself near the front entry gate. The remaining handicapped accessible spaces would be located within the Bicentennial Center parking area to the east. CITY OF SALINA REQUEST FOR CITY COMMISSION ACTION DATE 05/18/09 TIME 4:00 P.M. Page 5 BY: Siqnaqe - Signage for conditional uses in the R-1 district, which are primarily churches and schools, is limited to one ground sign not exceeding 32 sq. ft. plus up to two (2) wall signs. The preliminary development plan for the Aquatic Center proposes a 9 ft. x 6 % ft. (60 sq. ft.) identification sign south of the proposed drop off area. The sign would be set back 10ft. from the south property line. To the best of staff's knowledge no wall signs are being proposed at this time. Landscapinq - Based on the width and depth of the proposed Aquatic Center site, Planning staff has determined that 16,395 sq. ft. of the 5.92 acre site must be set aside for landscaped green space with a total of 33 tree units required within this landscaped area. The proposed landscape plan prepared by the project designer contains perimeter and interior landscaping consisting of shade, ornamental and evergreen trees, large and small shrubs and ornamental grasses and wildflowers that far exceeds the City's minimum requirements. Proposed tree plantings are all on the City's Recommended Tree List and the proposed shrubs and grasses are on the City's Xeriscaping Plant List. A decorative 6 ft. wrought iron fence is proposed around the south, west, and north boundaries of the site. Parkinq Lot - As a proposed addendum, the project designer is proposing an asphalt overlay and re- striping of the parking lot directly to the east of the Aquatic Center. The only on-site parking proposed is the construction of five (5) new handicapped accessible spaces in a small, self-contained parking area northwest of the main entrance. Additional handicapped accessible spaces will need to be provided in the east parking lot to serve the aquatic park. *Staff would note that the driving aisle proposed in the five (5) space handicapped accessible parking area is too narrow as proposed and will need to be widened to 24 ft. Traffic I Access I Circulation - The proposed site is bounded by public and private streets on all sides. The only public street is Kenwood Park Drive, the remaining roadways are internal park roads. As noted, the main entry gate would be oriented to the existing east parking lot. A vehicle drop off area is proposed south of the main entry gate in the southeast corner of the site to allow parents to drop off and pickup their children away from the main parking lot. A handicapped accessible ramp and paved walkway is also proposed that would allow patrons to get to the front entry gate from the north parking lot. A 10ft. wide sidewalk I multi-use trail is proposed outside the fence along the south and west perimeter of the site which could be used by bicyclists and pedestrians. There is a CityGo bus stop on YMCA Drive south of the site and others in the vicinity so this location will be accessible by multiple modes of transportation. Staff Analvsis Staff's analysis of the proposed Aquatic Center from a zoning conformance and compatibility standpoint is as follows: CITY OF SALINA REQUEST FOR CITY COMMISSION ACTION DATE 05/18/09 TIME 4:00 P.M. The minimum lot size for conditional uses in the R-1 proposed Aquatic Center site contains 5.92 acres. BY: Dean Andrew BY: district is 15,000 sq. ft. (1/3 acre). The . The proposed site is centrally located within the community and the new facility will increase the recreational opportunities available to Salina citizens and residents of the surrounding area. . There are a number of existing public facilities and activity centers in the vicinity including the existing municipal pool the Bicentennial Center and Salina Family YMCA and the site is more than 1,000 feet from any residential area. . The proposed pool structures on the site will blend in with the surrounding area and a fencing and landscaping plan were submitted with the PDD application. . Except for the occasional multiple event and shared use situations with the Bicentennial Center and fairgrounds, existing parking facilities are more than adequate to serve the proposed location. . There are adequately sized public water and sewer lines in the vicinity and site runoff will be directed to the old Smoky Hill River channel which has adequate capacity to accept additional runoff. . There will be public and private street access on all sides of the proposed facility and an off- street drop off area is being provided. The site will be accessible by multiple modes of transportation. . The proposed use (aquatic center) in the proposed location would be consistent with the Parks and Recreation designation of this area in the City's Comprehensive Plan and the zoning and uses of nearby property. Staff believes that the proposed preliminary development plan for the new Aquatic Center facility is compatible in design, layout, scale and character with the existing public facilities and uses in the Kenwood Park area as well as the facilities of the Salina Family YMCA to the south. CONFORMANCE WITH COMPREHENSIVE PLAN: This factor deals with whether the proposed rezoning would be contrary to the goals, objectives, policies of the plan and whether the proposed rezoning would require an amendment to the plan and whether an amendment could be reasonably justified. The City's current Future Land Use Plan designates this area as future Parks and Recreation. This designation envisions that the area could be developed with additional public recreation and entertainment facilities. Approval of a PDD (R-1) zoning district for a new aquatic center in this location would be consistent with this designation. Through research and negotiation, determine current ownership status and finalize future ownership designation . Develop an area-wide master plan . Finalize direction and an agreement regarding the current Expo Center facility property lease . Identify and overcome river channel challenges . Finalize plan for community-wide, outdoor aquatics facility with a detailed funding plan and timeline . Research financing alternatives and develop an acceptable financial plan to support future area development Planninq Commission Recommendation The Planning Commission conducted a public hearing on this PDD application on May 13, 2009. Following presentation of the staff report, comments from the Parks and Recreation Director regarding various aspects of the proposed facility and comments and questions from Commissioners, the Planning Commission voted 8-0 to recommend approval of a PDD zoning designation for this property, including the variations as to structure setback, structure height, sign size, shared parking, and the placement of structures over utility easements requested by the applicant subject to the following conditions: 1. Development limitations shall be as follows: a). Permitted uses in this district shall be limited to a public Aquatic Center facility consisting of swimming pools, water slides, spraygrounds and accessory support facilities and buildings. Development within the district shall be subject to the minimum building setback, maximum building height, and maximum lot coverage limitations and use limitations of the R-1 (Single-Family Residential) district, except for specific exceptions and variations approved by the governing body as part of the Planned Development District. 2. Parking - Off-street parking for the Aquatic Center facility shall not be required within the district but shall be provided in the City owned parking lots adjacent to the district which also serve the Bicentennial Center facility. 3. Signage - Signage within the district shall be limited to one (1) monument (ground) sign with a maximum permitted sign area of sixty (60) square feet and a maximum sign height of ten (10) feet and wall signs in accordance with the R-1 sign regulations. No pole signs shall be permitted within the district and no signs for businesses located outside the Planned Development District (off-premise advertising signs) may be erected within the district except as otherwise approved by the governing body. 4. Site Lighting - A site lighting plan for the Aquatic Center facility shall be submitted for City staff review and approval that includes the following items: the location on the premises and the type of illuminating devices, fixtures, lamps, supports, reflectors and other devices; a detailed description of the illuminating devices, fixtures, lamps, supports, reflectors and other devices including manufacturer's catalog cut sheets and drawings and sections upon request; photometric data such as that furnished by the manufacturer showing the angle of cut off or light emissions to reduce or eliminate light spill onto adjacent properties. 5. Screening - The screening of trash dumpsters is required within the district. No trash enclosures may be placed on the Kenwood Park Drive side of the facility. The City reserves the right to review and give final approval to all dumpster locations, screening plans and materials within the district. 6. Landscaping - Landscape plans within the district shall be designed to incorporate xeriscaping principles and shall be subject to City staff review and approval. Plantings used In landscape plans shall be from the City's Recommended Tree List and Recommended Xeriscape Plant List. All planting areas shall be maintained In accordance with Section 42-65(9) of the City's Landscaping Regulations. 7. Sidewalks - A public sidewalk shall be required on the east side of Kenwood Park Drive. The City reserves the right to determine the location and width of each sidewalk section. 8. Exceptions and Modifications - Requested modifications of otherwise applicable zoning regulations approved by the Planning Commission under the authority of Section 42- 403( 12) are specifically enumerated as follows: a). A reduction in the amount of required front yard setback along Kenwood Park Drive to allow two (2) inner tube storage structures to be located within nine (9) feet of the west (Kenwood Park Drive) property line and to allow elevated slide tubes for the water slide to be located within nineteen (19) feet of the west property line. b). A variance to the 35 feet maximum structure height limit in the R-1 district to allow a proposed roof covering a stair tower platform for the water slides that would be 48 feet in height. c). An exception to Section 42-552 (c)(7) to allow a shared parking arrangement with the Bicentennial Center without written assurances that the Bicentennial Center and Aquatic Center would operate at different or nonconflicting times. d). A modification of Section 42-517(4) to allow an identification sign greater than thirty-two (32) square feet in size. e). An exception to Section 42-63(a) to allow portions of a concession stand arbor and inner tube storage structure to be located within projected public utility easements. 10. Development within the district shall conform to the approved preliminary development plan, fencing plan, landscaping plan, signage plan and proposed building elevations which are herein incorporated by reference. In accordance with Section 42-403. Standards and criteria for planned developments, the Planning Commission made the following findings in support of their recommendation: 1. The proposed planned development will not substantially injure or damage the use, value and enjoyment of surrounding property nor hinder or prevent the development of surrounding property in accordance with the land use plan. 2. The proposed site will be accessible from public roads that are adequate to carry the traffic that will be imposed upon them by the proposed development and the streets and driveways on the site of the proposed development will be adequate to serve the residents, occupants, or users of the proposed development. The proposed location and arrangement of structures, parking areas, walks, lighting and appurtenant facilities will be compatible with surrounding land uses, and the parts of the planned development not used for structures, parking and loading areas, or access ways, will be landscaped or otherwise improved. 5. The modifications of the zoning regulations that would otherwise be applicable to the site being requested are warranted by the design of the site development plan, and the amenities incorporated in it, and are not inconsistent with the interest of the public generally. COMMISSION ACTION: If the City Commission concurs with the recommendation of the Planning Commission the attached PDD ordinance should be approved on 151 reading. The protest period on this application will expire on May 27, 2009 but there has been no indication that a protest petition will be filed. If this ordinance is approved on first reading, second reading would take place on June 1, 2009. If the City Commission disagrees with the recommendation of the Planning Commission, it may return this item to the Planning Commission together with the reason for the disagreement with three (3) affirmative votes or it may overturn the recommendation of the Planning Commission and deny this request provided there are four (4) votes in support of each action.
