Resolution No. 09-6625 amending Resolution 08-6501 related to the establishment of a benefit district
for street, drainage, water, and sanitary sewer improvements in the Red Fox Addition.
BACKGROUND:
Resolution 08-6501 was passed on June 23, 2008 and included the installation of a rear drainage
ribbon that benefited 9 residential lots within the subdivision. The wording of the petition and
associated Resolution indicated the cost of the drainage ribbon would be allocated equally among all
27 lots within the benefit district while the preliminary notices provided to the property owner (in this
case the developer) as well as the detail cost calculations attached to the petition and the Notice of
Futures recorded individually recorded against each lot within the benefit district correctly indicate the
proportional assessment of costs to the 9 lots receiving benefit.
This project was then constructed in 2008 and the final costs certified and presented to the City
Commission two weeks ago on April 27,2009. This began the public hearing process which is
intended to receive input from interested parties and particularly property owners within the special
assessment benefit district. As part of the review process associated with preparation of the
assessment ordinance, the discrepancy between the verbage in the petition and resolution and the
actual cost allocations was noted.
As a result, it is necessary to amend the original resolution to correctly indicate proportional
distribution of the drainage ribbon costs among the 9 lots benefiting from the improvement. It is also
necessary to have the affected property owner(s) execute an agreement consenting to the change.
Since the amendment reflects the originally expected cost allocation without an increase in actual
costs and the lots in question are still owned by the developer, a single consent agreement from the
developer is all that is necessary, and it has been obtained.
e primary issue at this point in the process is not whether the special assessments should be levied
against the properties, but rather that the final costs have been properly calculated and distributed.
FISCAL NOTE:
These costs were assessed against the improvement district and will now be rolled into long term
bonds as discussed in the next agenda item Ordinance No. 09-10499. Property owners will have the
opportunity to pay the assessment in full prior to the bond issue. If they elect not to do so, the
assessment plus related interest costs will be spread over 15 years in equal annual installments. As
with any assessment project, there is a certain amount of default risk, which will place demands on the
property tax. Default during the construction period is covered by the developer's financial security
requirements previously outlined. Non-payment of assessments after the expiration of the developer's
security is handled by Saline County in the same manner as delinquent taxes. We do not anticipate
any assessment deferrals or cost recovery features to be associated with this development.

SCOPE OF WORK
The curb, gutter, pavement and grading for approximately 1,125 lineal feet of Christy Lane, Sky Court
and Colton Court (the "Street Improvements").
The installation of approximately 326 lineal feet of storm sewer pipe, inlets, and all appurtenances thereto
(the "Drainage Improvements").
The installation of approximately 80 square yards of concrete drainage ribbon and all appurtenances
thereto (the "Concrete Drainage Ribbon Improvements").
The installation of approximately 1,563 lineal feet of six-inch water main, fIre hydrants, valves, fIttings,
service connections for water lines and all appurtenances thereto (the "Water System Improvements").
The installation of approximately 1,972 lineal feet of eight-inch sanitary sewer main, service connections
for sewer lines, manholes, and all appurtenances thereto (the "Sanitary Sewer Improvements").
BENEFIT DISTRICT
Red Fox Addition
Lots 1 through 7, Block 1, and Lots 1 through 20, Block 2, in the City of Salina, Saline
County, Kansas.
ADOPTION OF ASSESSMENT
The assessment with accrued interest to be levied as a special assessment tax upon the property included
with the benefIt district concurrent with the general property tax and shall be payable in fIfteen equal
annual installments.
Each lot and parcel of land in the improvement district shall be assessed equally per lot.
APPORTIONMENT OF COST
COST CHARGEABLE TO PRIVATE PROERTY:
One hundred percent (100%) of the total cost of improvements shall be assessed to the Improvement
District and no portion of costs shall be paid by the City at Large.

Craig Piercy, President of CR Development, Inc., has requested reimbursement of engineering fees for
infrastructure improvements to the Red Fox Addition. Engineering design was provided by Campbell &
Johnson PA. The total of the invoices for design fees is $47,310.00. Of this amount, $4,000.00 was invoiced
for platting and is therefore ineligible for reimbursement.
Please proceed with the reimbursement to CR Development, Inc., in the amount of $43,310.00: The
engineering fee will be incorporated into the fInal project costs and will be assessed to the benefIt district.
