Denial upon Second Reading of Ordinance 86-9161 providing for the rezoning of
certain property within the City for failure to complete required platting!
within the specified time period.
Background
Application #Z86-14, filed by William D. Sharp, requesting rezoning from RS
Residential to I-2 Light Industrial for a 58 acre tract of land in the NW¼ ofi
Sec. 14-14S-3W was approved on first reading on September 22, 1986, subject to!
platting.
On April 5, 1988, upon failure to complete required platting within 18 months)
(one year plus a six month extension), the Planning Commission recommended~
that the City Commission not grant an additional extension and close the casel
file on Application #Z86-14.
On April 18, 1988, the City Commission approved a motion to concur with thel
recommendation of the Planning Commission. The City Attorney recommends thatl
the ordinance previously approved now be denied.

ORDINANCE NUMBER 86-9161
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINAHCE
NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE
ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING
FOR THE REZONINC OF CERTAIN PROPERTY WITHIN THE CITY AND
PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described has
been timely complied with, and SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section I. AMENDMENT. DISTRICT I-2. LIGHT INDUSTRIAL
DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly
adopted and published as a part of Ordinance Number 8526, the same being
Chapter 42 of the Salina Code, be and it is hereby amended so that the following
described property be rezoned as follows, to wit:
The West 70 acres of the North 150 acres of the Northwest
Quarter (NW¼) of Section Fourteen (14), Township Fourteen
(14) South, Range Three (3) West of the Sixth Principal
Meridian in Saline County, Kansas, less and except the
following described tracts of land therein:
(1) Commencing at the point of intersection of the
center line of the channel of Dry Creek and the west
line of Tract Number Four in Surveyor's Plat 51, in
Saline County, Kansas, said point of intersection being
approximately 150 feet south of the northwest corner of
said Tract Four in Surveyor's Plat' 51; thence South
parallel with the west line of said Northwest Quarter
(NW¼) of Section Fourteen (14), Townshtp Fourteen
(14) South, Range Three (3) West of the Sixth
Principal Meridian in Saline County, Kansas,
approximately 226.5 feet to the south line of White
Avenue as the same appears in Surveyor's Plat 51;
thence West along the south line of White Avenue
approximately 485 feet to the center line of the channel
of' Dry Creek; thence down the center line of the
channel of Dry Creek in a Northeasterly direction to
the place of beginning.
(2) Beginning at a point on the west line of said
Section Fourteen (14), 707.1 feet south of the
northwest corner of said Section Fourteen (14); thence
South to a point 165 feet north of the southwest corner
of the Northwest Quarter (NW¼) of said Section
Fourteen (14); thence East to a point 125 feet East of
and 165 feet North of the southwest corner of the
northwest corner of said Section Fourteen (14); thence
Northerly to a point 220 feet East of and 707.1 feet
South of' the northwest corner of said Section Fourteen
(14); thence West to the point of beginning.
shall become a part of District I-2. LIGHT INDUSTRIAL DISTRICT. That the
use of said described property shall be subject to all the conditions, restrictions
and limitations as made and provided for in Ordinance Number 8526, the same
being Chapter 42 of the Salina Code, with reference to LIGHT INDUSTRIAL
DISTRICTS.
Section 2. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
