Kissinqer BY: Ordinance 88] 9240 An ordinance relating to use of the solid waste disposal area for the City of Saliina; authorizing the use of the solid waste disposal area for waste originating outside the City and the County by permit; adding supplemental provisions to Article Chapter 34, of the Salina Code; and amending Salina Code Section 34-82 and repeal!lng the existing section. Di scussi on: In recent Weeks, a McPherson. County solid waste contractor has been biddingi on disposal contracts for some large businesses and industry in Salina CouOty. Indications are he will gain some of this business, with the refuse to be disposed of at a McPherson County landfill. Saline County private haulers cannot currently gain similar contracts out of Saline County, due to our prohibition against out4of- county refuse of the City landfill. Staff review of the situation shows we have!the landfill capacity and operating capability' to accept a reasonable increase in volume, even originating out-of-county. If some of our industrial refuse volume is lessened by hauling to McPherson County, we would actually be rebuilding to our current volume. Properly monitored and controlled by a permit system, allowing ~ome out-of-county refuse disposal of our landfill would be in the best interest ofiour conmnunity due to: a) Maintenance of competition in the local solid waste business b) Possible stabilizing of our landfill tipping fee revenue which otherwise may fall with loss of large customers. Kissin~er BY: Ordinance #88- Page 2 Fiscal Note: Loss of fees from disposal of refuse from large Saline County businesses w~)uld eventually cause a financing problem for the city landfill operations, forcing r~ltes to be increased for remaining industrial, commercial and residential custom~)rs. Fees from new customers {out of county) could work to offset this revenue loss. The special permit system would leave the city in full control of volumes and type~ of refuse from out-of-county, so as to avoid negative financial 'consequences. In addition, maintenance of 'competition in the hauling business is generally .to the advantage of our business consumers. Staff Recommendation: Approve this 'ordinance to authorize the establishment of a special permit system for limited disposal of out-of-coUnty solid waste at the Salina City landfill. S':aff will be able to answer questions at the Commission meeting. COMMISSION ACTION MOTION BY SECOND BY TO: (Published in The Salina Journal April , 1985) ORDINANCE NUMBER 88-9240 AN ORDINANCE RELATING TO USE OF THE SOLID WASTE DISPOSAL AREA FOR THE CITY OF SALINA; AUTHORIZING USE OF THE SOLID WASTE DISPOSAL AREA FOR WASTE ORIGINATING OUTSIDE THE CITY AND THE COUNTY BY PERMIT; ADDING SUPPLEMENTAL PROVISIONS TO ARTICLE IV, CHAPTER 34 OF THE SALINA CODE; AMENDING SALINA CODE SECTION 34-82 AND REPEALING THE EXISTING SECTION. BE IT ORDAINED by the .Governing body of the City of Salina, Kansas: Section 1. That Section 34-82 of the Salina Code is hereby amended to read as follows: "Section 34-82. Use restricted. All persons shall be privileged to use the facilities of the solid waste disposal area upon payment of the established fees for the depositing or dumping of solid waste originating with the city or county. In the interest of assuring the city's ongoing capability for the disposal of solid waste originating In the city and county, no person shall use the facilities of the solid waste disposal area for the purpose of disposing of solid waste originating outside the city or the county without first obtaining a permit from the city." Section 2. That Article IV of Chapter 34 of the Salina Code is hereby amended by adding Section 34-86, which shall read as follows: "Section 34-86. Permit for disposal of waste ori~linatino~,, outside the city or county. Application for such a permit shall be made on forms 'made available in the office of the city clerk. The application shall specify the following: a. the specific source of the waste material b. the specific nature of the water material c. the estimated volume and frequency of dumping d. the name, address and telephone number of the individual or firm requesting the permit." Section 3. That Article IV of Chapter 34 of the Salina Code is hereby amended by adding Section 34-87, which shall read as follows: "Section 34-87. Same; approval of permit. The city manager is hereby authorized to grant any permit application after determining that: a. processing the nature and volume of the proposed waste material will not have an adverse financial impact on operation of the city's solid waste disposal area; b. the nature of the proposed waste material will not have an adverse environmental impact on the city's solid waste disposal area; and c. the nature and volume of the proposed waste material will not have an adverse affect upon the capability of the city's solid waste disposal area to accommodate the future solid waste disposal needs of the city and county." Section 4. That Article IV of Chapter 34 of the Salina Code is hereby amended by adding Section 34-88. "Section 34-88. Same; terms of permit. The permit shall be issued to the applicant upon approval by the city manager and upon payment of the established permit fee necessary to offset the administrative expense of processing the permit application. The permit shall be for a period not to exceed five (5) years and shall be limited to the source, volume, and frequency of use shown on the permit based upon review under the criteria outlined in Section 34-87. Any deviation from the stated volume and frequency of dumping shall require reapplicatlon for possible reissuance of a revised permit. Any deviation from the source shown on the permit shall result in forfeiture of the permit." Section 5. That Article IV of Chapter 3a, of the Salina Code is hereby amended by adding Section 34-89, which shall read as follows: "Section 34-89. Same; nontransferability; presentation and payment of use fees. The permit shall not be transferable by the original permit holder to any other person or firm without prior approval by the City. The permit must be presented at the solid waste disposal area on each occasion of its use pursuant to the permit. The permit holder shall pay the standard fees established for use of the solid waste disposal a rea." Section 6. That the existing Section 34-82 is hereby repealed. Section 7. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper. Introduced: March 14, 1988 Passed: March 28, 1988 Stephen C.
