description: East 80', S½ of Lot 133, and all of Lots 125, 137 on South
Santa Fe Avenue, Original Town Addition to the City of Salina (aka 153-163
S. Santa Fe), known as the Fox Theatre.
Information
On October 25, 1989, the Heritage Commission conducted a public hearing on
the above application. Notification was provided to property owners in
accordance with city code. No one appeared at the public hearing to comment
on the proposed designation. HC Landmark zoning designation places a
restriction on the property which could delay demolition of the structure
and provides for a design review permit process for any exterior alteration.
It also makes possible exceptions to building code requirements to preserve
historic features when public health and safety are not compromised. At the
close of the hearing, the Heritage Commission approved a motion (6-0) to
recommend that the subject structure be designated a Heritage Conservation
Landmark for reasons of architectural and historical significance.
Recommended Action
If the City Commission concurs with the above recommendation, the attached
ordinance should be placed on first reading. Second reading is scheduled
for November 13. If the City Commission disapproves of the designation,
the application and basis for disapproval should be returned to the Heritage
Commission for reconsideration.

Chairman Bieberly called the meeting to order at 4:03 p.m.
#1. Minutes of July 26, 1989.
Chairman Bieberly asked if there were any comments or corrections to the
minutes of July 26, 19897
Mrs. Denton stated that on Page 3 the name "Jean Holstein" should be spelled
"Gene Hulstine".
There being no further comments, the minutes were approved as amended.
#2. Application #HC89-2, filed by the Salina City Heritage Commission.
Mr. DeYoe showed the commission pictures of the Fox Theatre before
renovation and after. He stated that this is an application for heritage
conservation designation for property known as the Fox-Watson Theatre.
This area is approximately 14,500 sq. ft. The zoning for this area is C-4
and the site is in the Business Improvement District #1. The use of the
structure was commercial and the future land use is seen as commercial.
Neighboring properties are also zoned C-4 in the Business Improvement
District #1. Plans for the construction actually started in the mid-
1920's by W.W. Watson, a prominent banker and businessman in Salina during
this period. His first attempt in pursuading Fox-Midland Theatre circuit to
build on the site was met with concerns by the public. However, later W.W.
Watson lead a fund raising campaign and raised some of the $400,000 needed
to build the theatre and donated the land in which he owned for this site.
The theatre was named in honor of W.W. Watson. The designers of the
Fox-Watson theatre were the Bolen Brothers of Kansas City and the chief
architect and project supervisor was Charles W. Shaffer. The builders were
Busboom and Rauh. The building was completed in 1931. Materials used in
the construction of this building was steel framing with brick exterior and
terra cotta trim with a spanish barougue ticket box. The building retains
most of its original design with a few exceptions. One exception is the
removal of the top portion of the step tower and neon lighting in the
1950's after being struck by lightening. A second alteration of the
building was the replacement of the original cast iron marquee in 1954 and
some light exterior trim repainting. None of the front brick has been

painted over, just the wood portions of the structure. Most of the
repainting occurred on the interior. The structure is one of a very few art
deco theatres built in this part of the country. The theatre is presently
on the National Register of Historic Places and staff recommends that the
Fox-Watson Theatre be designated as a Salina heritage landmark so that its
influence can be enjoyed for generations to come.
Mr. Burr stated that he is highly in favor of approving designation.
Chairman Bieberly asked when it was put on the national register?
Mr. DeYoe stated that it was in August of 1988.
Mrs. Lilly arrived at this time.
Mr. Dudark stated that Jean Brewer did alot of research on the Fox Theatre
and the State Architectural Historian, Martha Hagedorn-Krass, completed all
the paperwork necessary and took it to the Historical Review Board. The
designation was approved by the State and the Secretary of the Interior even
with the changes as the changes were basically caused by a natural disaster.
There are some questions as to why you would want local designation when it
is protected by national register status. The most important reason is that
it would not be just the State deciding what changes could be made to the
theatre or what its future might be, it would be this board and the City
Commission that would have a more direct role as well as with any design
changes that would take place to the exterior.
Chairman Bieberly asked what the changes would be?
Mr. Dudark stated that it is now a city property. It was deeded to the
city by Dickinson Theatres. The City Commission has approved a new roof
for the building to protect the integrity of the structure. There is a
group headed by the Symphony and various other non-profit organizations that
have made a proposal to the city to share in the cost of renovation. That
project has been put on hold until the feasibility is determined and steps
are made towards raising those funds. They have requested more time to get
their plan organized before their proposal would be formally considered.
The city is going to go ahead and fix the roof to save the structure.
MOTION: Mr. Marietta moved that the commission approve Application #HC89-2 for
heritage conservation designation as it is architecturally and historically
significant to the City of Salina.
SECOND: Mr. Burr seconded the motion.
VOTE: The vote was unanimous (6-0) in favor of the motion. Motion carried.

163 SOUTH SANTA FE AVENUE FOR HERITAGE CONSERVATION (HC)
LANDMARK DESIGNATION,
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That the structure located on the following described real
estate to wit:
East Eighty (80) feet of the South half of Lot One Hundred
Thirty-three (1:33), all of Lots One Hundred Thirty-five
(135) and One Hundred Thirty-seven (137), Santa Fe
Avenue, Original Townsite of the City of Salina, Saline
County, Kansas.
Commonly known as 153 - 163 South Santa Fe Avenue.
be and the same is hereby designated as Heritage Conservation (HC) Landmark.
Section 2. That this ordinance shall be in full force and effect from
