Information The applicant is requesting final plat approval of a 2 lot subdivision. The property is already developed with a duplex and the property line dividing the lots follows the common wall of the duplex. This division of property will allow the sale of each attached unit and the surrounding lot. Restrictive covenants will provide for common wall maintenance and other joint ownership responsibilities. All existing street rights-of-way and utility easements will be retained. Planning Commission Recommendation On September 5, 1989, the Planning Commission conducted a public hearing on this application. Following discussion, a motion was passed (6-0) to recommend approval of the final plat. Cit~ Commission Action If the City Commission wishes to approve the plat, a motion should be passed authorizing the Mayor to sign the plat drawing. If the City Commission wishes to disapprove the plat, a motion should be passed to return the item to the Planning Commission for reconsideration along with a statement regarding the reason for disapproval. Salina City Planning Commission September 5, 1989 Page 6 Mr. Haworth returned to the table. #7. Application #P89-6/6A, filed by Vance Miller. Mr. Dudark stated that this is an application for final plat approval for the Miller-Waeldon Addition. This is a lot within the Georgetown Addition that has already been split once. The applicant desires to split this lot again. Under the city's subdivision regulations and the state statutes, the second split requires a replat of the affected lots. This application will divide that lot again to the east and west through the common wall of a duplex which is presently located on the property. This would permit the sale of each half of the lot once this is recorded without having to have a PDD development application. This would provide a simpler mechanism for that to take place with duplexes. They would then be able to get a deed and title to Lots I and 2 including the structures that are located thereon. The plat meets the requirements of the city's regulations with regards to the size and widths of the lot. The setbacks are all adequate. This does perpetuate the easement on the northwest side of Lot 1. All the rights- of-way are the same, 30' from the cen%erline. Staff would recommend approval of the plat without any special conditions. Mr. Haworth asked what kind of easement would be on the west side. He stated that maybe there should be another easement to the back so power lines could get to the other side. Mr. Dudark stated that that would be by agreement between the owner and the power company. He stated that we sent the proposed plat to the power company and they did not indicate any requests for any additional easements. He stated that he presumes that they could provide service as there would be no visible change in the property. Mr. Kline asked if this would allow them to sell the units individually? Mr. Dudark stated that presently it is owned by one owner. With this division of property, there could be two owners. There would have to be a common wall agreement between the two owners to be recorded. That is a private matter. Chairman Gaines asked if the applicant would care to make a comment regarding this application? Vance Miller, 309 Channel Drive, stated that he has nothing to add. Chairman Gaines asked the applicant if there is any concern about adding an easement to access the south lot? Vance Miller stated that there is a covenant between the two owners that carries over to the future owners of the lots. It is patterned after the duplexes Mel Jarvis has one block east. Mr. Dudark stated that staff sees no need for an easement with such an agreement. MOTION: Mr. Morris moved that the commission approve Application #P89-6/6A as it does not change the character of the neighborhood and is suitable to the site proposed, the public facilities and services are adequate. SECOND: Mr. Kline seconded the motion. VOTE: The vote was unanimous (6-0) in favor of the motion. Motion carried. #8. Other Matters. Mr. Dudark stated that the next meeting of the Planning Con~ission will be September 19. There being no further business, the meeting was adjourned at 4:55 p.m. ATTEST:
