The proposed Resolution Number 89-q0,?~9, authorizes the Mayor to execute the attached
right-of-way agreement with Richard E. Brown. The proposed agreement grants
permission to Richard E. Brown to install and maintain a private waterline, subject
to the following condi~cions:
A. Grantee shall maintain the waterline in good working condition and
hold the City harmless from any liability that might arise from the
use-and maintenance of the waterline.
B. Materials and plans shall be approved by, or as directed by the City
Engineer.
C. Grantee shall relocate the waterline at any time the City determines
such relocation t° be necessary, at Grantee's expense.
D. Grantee's access to the waterline following initial installation for
whatever purpose shall be subject .to the Salina Code provisions
relating to excavations in public right-of-way.
Mr. Richard E. Brown, 626 East Prescott Road lives directly across the street from
his father, Mr. Ralph E. Brown. This agreement would allow their lawn watering
systems to be connected with a 1" diameter waterline installed under the pavement
of East Prescott Road.
