Petition No. 3967 filed by various prop.erty owners, for certain sanitary sewer
improvements in Meyer Addition, was referred to the Engineering Department for
a recommendation on April 3, 1989.
Kansas statutes state the City Commission may find a petition for street, utility,
etc., improvements sufficient if it is signed by enough owners to fulfill any one
of these three (3) requirements, (i) a majority of the resident owners of record
of property liable for assessment under tile proposal, or (ii) the resident owners
of record of more than one half of the area liable for assessment under the
proposal, or (iii) the owners of record (whether resident or not) of more than
one half of the area liable to be assessed under the proposal.
The petition signers represent 66% of the area liable for assessments (within the
benefit district) and 50% of the resident owners. Therefore, the petition meets
the Kansas statute requirement for a sufficient petition. The Saline County
Treasurer has certified that there are no delinquent taxes and special assessments
on any property within the benefit district owned by the petitioners.
We are filing a feasibility report for the above requested improvements and re-
commend the City Commission pass a resolution determining the. advisability of this
project. The property owners within the benefit district shall be assessed 85%
of the project costs and the City of Salina will be liable for the special
assessments on the three lots set aside for park purposes in this block.
The total cost of this project is estimated to be $15,076.50, all of which would
be financed by the City and paid over a 10 year period by the. property owners
within the benefit district.

SCOPE OF WORK
The installation of 8" sanitary sewer to serve Lots 1 thru 22,
Block 5, Meyer Addition, Salina, Kansas.
BENEFIT DISTRICT
Lots 1 thru 22, Block 5, Meyer Addition, Salina, Kansas.
ADOPTION OF ASSESSMENT
The assessment with accrued interest to be levied as a special
assessment tax upon the property included within the benefit district
concurrent with the general property tax and shall be payable in ten
(lO) equal annual installments.
The method of assessment shall be based on the adjusted front footage
of each lot of land and without regard to buildings or improvement of
the land.
APPORTIONMENT OF COST
COST CHARGEABLE TO PRIVATE PROPERTY
1. 100% of the total cost of 8" sanitary sewer lines, manholes, clean-
outs, fittings, trenching, backfill, compaction and any incidentals
thereto to complete the sanitary sewer system to serve Lots 1 through
10 and Lots 14 through 22.
COST CHARGEABLE TO CITY AT LARGE
1. Lots ll, 12 and 13 are presently owned by the City of Salina and re-
served for possible park usage. These lots will be liable for 100%
of the total cost of 8" sanitary sewer lines, manholes, cleanouts,
fittings, trenching, backfilling, compaction and any incidentals
thereto to complete the sanitary sewer system to serve these lots.
