Application #P00-2/2A, filed by Georgetown, Inc., requesting approval of a replat of the North
120 ft. of Block 5 of the Georgetown Addition to be known as the Pheasant Lane Addition.
The subject property is located on the south side of Pheasant Lane between Beechwood
Road and Fairdale Road.
Background
The Georgetown Addition was platted in 1974. Block 5 was platted as one large block and
has been zoned R-3 (Multi-Family Residential) since 1977. The southern 2/3 of this block
was split off and sold to Sterling House in 1996 and is now occupied by an assisted living
facility for the elderly. A petition to vacate Beechwood Road between Crawford Street and
Pheasant Lane was recently approved by the City Commission and the vacated right-of-way
reverted back to the property owners on the east and west sides of that former street.
Nature of Current Reouest
This application has been filed by Elly Ritter on behalf of Georgetown, Inc. requesting
approval of a replat of the North 120 ft. of Block 5, Georgetown Addition. The applicant is
now proposing to further subdivide the remaining portion of this block into seven (7) lots to
allow construction of homes on individual platted lots. This block is zoned R-3 which would
allow the construction of duplexes and multi-unit dwellings as well as single-family homes but
the applicant has indicated that it is her intent to construct more patio homes similar to what
has been built on the south side of Pheasant Lane west of Beechwood Road.
State statutes and the City's Subdivision Regulations state that a platted lot may be split one
time to create two building lots. Any additional splits require replatting of the property. In this
case Block 5 has been split once and the applicant is proposing to create multiple building
lots. Therefore a replat of the property is required before building permits can be issued.
The purpose of the plat review is to insure that proposed lots have adequate frontage on a
public street and are large enough to be buildable and that needed street right-of-way and
easements have been provided. Because this proposed subdivision is a replat of an existing
platted lot and no new streets or major easement dedications are being proposed it is being
considered in one step as a combined preliminary and final plat.

Lot Design
The R-3 district requires a minimum lot width of 50 ft., a minimum lot depth of 100 ft. and a
minimum lot size of 6,000 sq. ft. for single-family and two family dwellings. The applicant's
proposed building lots exceed those requirements. The five middle lots are approximately
60 ft. wide by 120 ft. deep which is 20 ft. deeper than the lots west of Beechwood. The
corner lot at Pheasant Lane and Fairdale Road is larger due to the curve on Fairdale. Lot
1 at the west end is 74 ft. wide due to a 20 ft. utility easement that was retained when
Beechwood Road was vacated.
Title to the west half (west 30 ft.) of the vacated Beechwood right-of-way actually went to the
adjoining property owner to the west, the owner of Lot 6, Block 2 and not to the applicant who
received title to the east half only. Therefore the applicant will either need to acquire that 30
ft. strip from the owner of Lot 6 or that owner will have to agree to sign the plat before it can
be recorded. Otherwise that 30 ft. would have to be deleted from Lot 1 and the replat area.
Street Access
All seven (7) proposed lots would have frontage on and driveway access to Pheasant Lane.
Utilities
1. Water - There is a 6" water main in Pheasant Lane which is adequate to serve
residential development on these lots. Staff would note however that there is only one
existing tap on this main because it was not anticipated that there would be multiple
building lots on this block. Therefore the applicant or individual home builders would
be responsible for the cost of installing taps to serve individual dwellings on this block.
2. Sanitary Sewer - An 8" sanitary sewer was installed between Beechwood and Fairdale
when the Sterling House was constructed in 1997. This sewer line is located on the
rear 10 ft. of the proposed lots. This line currently serves Sterling House but is
adequate in capacity to serve additional households.
3. Storm Drainage - These proposed lots would drain to Pheasant Lane. The curb and
gutter system would carry the runoff to Fairdale Road and then south to a 36" storm
sewer under Crawford Street. No on-site drainage improvements are needed to
accommodate single-family development on this site.

Easements and Dedications
The right-of-way for Pheasant Lane and Fairdale Road was dedicated on the original
Georgetown plat and no changes are proposed on this replat. A petition to vacate the right-
of-way for Beechwood Road received final approval by the City Commission on February 28,
2000. A utility easement to accommodate existing Southwestern Bell underground cable was
retained as part of the vacation action and is shown on Lot 1. The only new dedication on
this replat is a 10 ft. utility easement for the existing sewer line on the rear of these lots. ^
twin 10 ft. easement has been dedicated on the Sterling House property.
^ 10 ft. utility easement is shown on the plat between Lots 5 and 6. Staff is recommending
that this easement be deleted because the water line it is supposed to accommodate is being
abandoned.
Plannina Commission Action
The Planning Commission considered this proposed replat at their March 7, 2000 meeting.
Following presentation of the staff report and discussion and questions the Planning
Commission voted 7-0 to approve of this proposed replat of the North 120 ft. of Block 5,
Georgetown Addition subject to the following conditions and corrections:
1. The applicant shall acquire title to the west half of the vacated Beechwood Road right-
of-way or the owner of Lot 6, Block 2 shall agree to join in and sign the replat or the
west half of the vacated Beechwood Road right-of-way shall be deleted from the plat
prior to City Commission consideration of the replat.
2. The 10 ft. utility easement between Lots 5 and 6 shall be deleted from the plat and all
technical corrections on staff's corrections punchlist shall be made to the plat drawing
and plat certificates prior to City Commission consideration of the replat.
City Commission Action
The applicant has received a signed quit claim deed from the owner of Lot 6, Block 2 deeding
over their ownership interest in the west half of vacated Beechwood Road and the proposed
10 ft. easement between Lots 5 and 6 has been deleted from the plat drawing. Therefore,
conditions #1 and #2 have been complied with.

City Commission concurs with the action of the Planning Commission, a motion should be

Mr. Andrew gave the staff report sent to the Planning Commission and
applicant. He recommended that the Planning Commission approve this
replat subject to the applicant acquiring clear title to that west half of
Beechwood Road prior to the recording of the plat and also the deletion of
the 10 ft. utility easement between Lots 5 and 6 before the plat is recorded
Mr. Thompson asked are there any questions of staff? Hearing none would
the applicant care to comment?
Dick Blackwell, 400 E. Iron. I represent the applicant. She has already
made arrangements with the homeowner to get title to that piece of
property and that is not going to be any problem so that has already been
accomplished. She was aware also that there was .no water line taps and
necessary easement between those lots on the right hand side so she is
aware of that so replatting it, taking that easement out isn't a problem
either. I don't think there is anything else she is surprised by from what was
said today based on what she told me, Elly Rifler, who is on vacation asked
me to appear before this commission or meeting group with those things.
Mr. Thompson asked are there any questions of Mr. Blackwell?
Mr. Haas asked are the plans to construct single-family homes now?
Mr. Blackwell stated I believe so. I think they have built what I call patio
homes along Pheasant, actually my mother I think lives a couple of doors
...... up to the west of that red line and I am almost positive that is what her
plans are is for her to continue to build those homes in there.
Mr. Thompson asked are there any other questions?
Mr. McDowell asked this is not really bearing on this but this is a replat so if
they didn't replat it, then what would they be allowed to do without any
further action? Build multi-family or a complex?
Mr. Andrew stated yes you could build like a 6-plex or however many units
the square footage would allow but something that would keep the property
under one ownership just like Sterling House is. The reason for the replat
is they are proposing to divide the property into multiple ownership.
Mr. Thompson asked are there any further questions or discussion?
Hearing none I would entertain a motion.
MOTION: Mr. Morse moved to approve Application #P99-2/2A with the two conditions
or corrections that the staff has recommended.
SECOND: Mr. Haas seconded the motion.
Mr. Thompson stated just for the sake of making sure we are correct is it
#P00 or #P997
Mr. Andrew stated it is supposed to be #P00.
