An ordinance amending Chapter 25, Article V, Sections 25-81 and 25-82 of the Salina City Code
pertaining to furnishing alcoholic liquor and cereal malt beverages to a minor.
BACKGROUND:
-rhe proposed ordinances would incorporate changes in state law that occurred during the 2008
legislative session. -rhe legislation was drafted to expand the defense to that crime to apply to
licensed entities or employees who have provided alcohol or cereal malt beverages to a minor who
they reasonably believed was 21 or more, and who exhibited an I D that reasonably appears to contain
a picture of the minor and purports to establish the n"linor was 21 or more.
City Staff is recommending emergency consideration for both first and second reading at Monday's
meeting, as changes in the state law took effect on July 1, 2008.
COMMISSION ACTION:
Approve Ordinance No. 08-10463 on first reading, declare that an emergency exists so that second
reading can take place on the same day, and pass the ordinance on second reading.
