Bengtson, City Attorney RE: Proposed open meetings Consent Agreement DATE: March 30, 1990 Late this afternoon I was advised by the County Attorney that the proposed Consent Agreement relating to the Kansas Open Meetings Act meets her approval. A copy of the proposed Consent Agreement is attached. Although the indication of approval came at a time that did not allow including the matter on your formal agenda for Monday's meeting, you may wish to consider authorizing the Mayor to execute the Consent Agreement under "Other Business." Thank you. CONSENT~AGREEMENT This Consent Agreement is entered into this day of , 1990, by and between the Board of C~-~y Commissioners of the City of Salina and the Saline County Attorney. WHEREAS, Pursuant to the Kansas Open Meetings Act (the "Act"), notice of the date, time and place of any regular or special meeting of a public body, including the Salina City Commission, must be furnished to any person requesting such notice [K.S.A. 75-4318(b)]; and WHEREAS, it is the desire of the Board of city Commissioners of the City of Salina (the "city Commission") to confirm that it has and shall continue to strictly comply with the letter and spirit of the Act in the furnishing of notice of its meetings to any person requesting such notice. THEREFORE, the parties acknowledge and agree as follows: 1. Notice of Meetings. The City Commission expresses its concurrence with the public policy articulated in the Act and acknowledges its legal duty under the Act to provide notice of its meetings for the conduct of governmental affairs and the transaction of governmental business to any person requesting such notice. The list of such persons requesting notice of the meetings of the city Commission shall be maintained in the office of the city Manager, Room 202 of the City-County Building, 300 West Ash, Salina, Kansas. 2. Notice of Other Gatherings. The City Commission recognizes that in the course of daily affairs circumstances can arise in which a majority of a quorum of the City Commission may be present at an event or meeting that would not be covered by the Act. As a means of minimizing any confusion or speculation as to whether a particular meeting at which a majority of a quorum of the city Commission may be present is subject to the notice requirements under the Act, the City Commission shall instruct the City Manager to prepare a list of all known events or meetings during the upcoming week at which it is anticipated that more than one Commissioner will be in attendance. The list shall be mailed along with the weekly City Commission agenda to those persons who have requested such notice. This effort to provide such additional notice shall not be construed to expand the scope of the city Commission's legal.duty under the Act to give notice of its meetings for the conduct of governmental affairs and the transaction of governmental business.
