Petition Number 3989 was filed by Warren SChmidt, Brown Industries, Inc. for the
vacation of that portion of unimproved Fourth Street located on the side side of
the branch of the Union Pacific Railroad tracks running through Fourth Street
from the north line of North Street, North to the Union Pacific Railroad tracks.
The petitioner has paid the required $50.00 filing fee.
Recommended action
This petition should be referred to the City Engineer for a recommendation and
the establishment of a public hearing date.

We, the undersigned, being residents and property owners in
the City of Salina, Kansas, do hereby Petition Your Honorable
Body for:
The vacation of that portion of unimproved Fourth
Street located on the West side of the branch of the
Union Pacific Railroad tracks running through Fourth
Street from the North side of North Street, North to
the Union Pacific Railroad tracks, all as more
specifically outlined on Exhibit "A" which is attached
hereto and by reference made a part hereof.
In support of this Petition, Petitioner shows that it
operates a hydrogen plant, together with hydrogen and methanol
storage, along Fourth Street at this location which it intends to
modify pursuant to the diagram which is attached hereto as
Exhibit "B" and by reference made a part hereof. In order to
facilitate the relocation of the various components of the
facility and remain in compliance with city, state and federal
regulations, it is necessary that Fourth Street be vacated as
petitioned for herein.
In further support of this Petition, Petitioner shows that
in discussions with the City Engineer's Office, it has been
determined that this area is zoned I-E; that the Salina Fire
Department and Salina City Manager have expressed concerns about
the present layout of the Plant; that the modifications proposed
are in accordance with City, State and Federal regulations; that
the Union Pacific Railroad has no vested lease or interest in the
portion of Fourth Street proposed to be vacated; that the Union
Pacific Railroad has only requested a twenty (20) foot margin
between its tracks and the Plant facility; that there will be a
twenty (20) foot margin between the tracks and the Plant facility
fence line and a thirty (30) foot margin between the tracks and
the four (4) foot dike surrounding the storage tanks; that there
are no utilities or easements which would be involved in the
vacation of this portion of Fourth Street; and that this portion
of Fourth Street is unimproved and is used principally by the
Petitioner.
