Report on Petition No. 4207 requesting vacation of a portion of the utility easement
located on Lot 4, Block 1, Frank Industrial Area Addition.
BACKGROUND:
Petition No. 4207 was submitted on June 30, 2000 by Mr. Joe Frank on behalf of Jumpin
Joe's, L.L.C. The petition requests vacation of a portion of the north-south utility
easement located on Lot 4, Block 1, Frank Industrial Area Addition. Jumpin Joe's L.L.C.
owns all of Lot 4, Block 1, Frank Industrial Area Addition. The purpose of this request is
to correct a building encroachment on the easement. A map of the area has been
attached for your review.
Public infrastructure improvements were completed in January of 2000 to serve the Frank
Industrial Area Addition. These public improvements were included as part of the 1999
Subdivision Improvements, Phase III and consisted of paving/drainage improvements on
Sunflower Lane and the installation of water and sanitary sewer systems. During
construction of the Jumpin Joe's facility, the facility's maintenance building was
inadvertently constructed over the easement in question and over the water pipeline. The
water pipeline has since been relocated at the expense of the property owner. The
property owner also rededicated a new utility easement to accommodate the relocated
water pipeline. Due to the building encroachment, both the easement and water pipeline
have been shifted east of their previous location.
There are no other utility lines located within the portion of the utility easement requested
for vacation. The new easement dedication will accommodate any future utility needs
within the easement.
RECOMMENDATION:
It is recommended that the City Commission approve the ordinance allowing for vacation
of a portion of the utility easement located on Lot 4, Block 1, Frank Industrial Area
Addition.
