This agreement is made and entered into this theJt day of March, 2008, by and between the SALINA
AIRPORT AUTHORITY (the "Authority") and the CITY OF SALINA, KANSAS (the "City").
Recitals
A. The Authority is a political subdivision of the City created by City ordinance pursuant to
the provisions ofK.S.A. 27-315 and operates the Salina Municipal Airport (the "Airport"). All Airport
property lies within the incorporated city limits of the City.
B. The City is a municipal corporation and has undertaken the responsibility for fire
protection and fire fighting activities within the incorporate city limits of the City. The City's fire
protection responsibilities are carried out by the Salina Fire Department.
C. After the opening of the Salina Municipal Airport at the former Schilling Air Force Base
in July, 1966, the City assumed the responsibilities of both structural fire protection and Aircraft Rescue
and Fire Fighting protection (ARFF) at the Salina Municipal Airport. To accomplish these duties, the
City occupied the former Schilling Air Force Base fire station which was designated as City of Salina Fire
Station #3.
D. In 1986, the City of Salina completed the construction of a new City of Salina Fire
Station #3 on Belmont Boulevard. The City subsequently vacated the former Schilling Air Force Base
fire station.
E. On November 18, 1985 the Authority and the City entered into an agreement providing
that, when the City relocated to the new Salina Fire Station #3, Authority personnel would assume the
responsibility for operating ARFF equipment with its own personnel with back up equipment and
personnel provided by the City.
F. The Authority publishes ARFF Service Hours in the US Department of Transportation's
Airport Facility Directory (AFD). The hours of ARFF services are subject to change. The current
published hours of ARFF service are:
Sunday - Saturday 7:00 A.M. to 11:00 P.M.
G. There are occasions when the Authority may request the City to provide ARFF services
during times when the Authority is not scheduled to provide ARFF service. Such a request is commonly
referred to as "After Hours ARFF Service."
H. The Authority is willing to continue to 'provide aircraft rescue and fire fighting services in
order to meet Federal Aviation Administration airport certification regulations for commercial service
airports pursuant to Federal Aviation Regulation, Part 139. (FAR Part 139).
I. The City is willing to continue to provide personnel and equipment for the Authority at
such times as such services are required during the times that the Authority provides ARFF services.
J. Both parties desire by this agreement to update and revise the July 16, 2003 agreement.
NOW THEREFORE, it is mutually agreed by and between the Authority and City as follows:

1. Purpose of Coutract. This contract is for the purpose of securing the services of the
City for personnel and equipment to respond to aircraft rescue and fire fighting emergencies at the
Airport. The safety of the general public using the Airport is best served by the Authority and the City
entering into this agreement. Specific Services to be contracted for are as follows:
a. Aircraft fire suppression support,
b. Extracation and rescue of aircraft crew and passengers; and

c. Incident command.
2. Terms. This agreement shall be for a term of one year, commencing on March I, 2008
and shall continue thereafter on an annual basis. The Authority and City will annually review the terms
and conditions of the agreement during the ninety (90) day period prior to' the anniversary date.

3. ARFF Service Costs. The Authority shall pay the hnnual costs necessary for ARFF

training equipment purchases and equipment maintenance in order t<1 meet the requirements for an FAA
certificated commercial service airport and compliance with FAR Part 139. The Authority's
responsibility will include the City's direct billable costs for ARFF training, equipment purchases and
equipment maintenance in accordance with FAA airport certification, standards, and pursuant to the
Authority/City Training and Equipment Plan.
4. After Hours Standbv ARFF Service. Upon a request by the Authority, the City will
provide ARFF standby at the Airport during hours not published in the AFD. The City will bill the
Authority at a rate of $250.00 per hour for after hours ARFF service., The after hours billing rate will be
reviewed annually and be subject to an annual adjustment, not to exceed the annual change in the CPI
urban index. !

5. Standard Operatinl! Guides. The Authority's executive director and the City's fire
chief will develop and adopt standard operating guides that enable Authority and City personnel to carry
out the terms and intent of this agreement. Standard operating guides will include, but not be limited to,
the following ARFF services functions: '
a. ARFF and incident command procedures to be followed by Authority and City
personnel at the Airport.
b. ARFF vehicle inspections and maintenance.
c. ARFF equipment inspections and maintenance.
d. Joint Authority and City ARFF training materials, syllabuses, classes, activities
and records.

The Authority's executive director and the City's fire chief will develop any other standard operating
guides as deemed necessary by mutual consent. I'
6. Joint Traininl! Plan. The Authority's executive director and the City's fire chief shall
annually develop and review ajoint training plan for both parties' pe~sonnel assigned with aircraft rescue
and fire fighting duties. The training plan will outline the training nclcessary to comply with FAA airport

certification requirements and comply with FAA Federal Aviation R\"gulation Part 139.

7. Eauipment Plan. The Authority's executive director and the City's fire chief will
annually develop and review an equipment plan for aircraft rescue arid fire fighting services to be

provided at the Airport in accordance with federal aviation regulations. The equipment plan will identify
both short term and long-term equipment acquisitions deemed necessary for providing ARFF services at a
commercial service airport and compliance with FAA Federal Aviation Regulation Part 139.
8. Termination or Amendment. Either party to this Agreement may terminate or request
an amendment of the Agreement by giving the other party at least ninety (90) days written notice of its
intention to terminate or renegotiate any of the terms thereof.
IN WITNESS WHEREOF, the parties have hereunto caused this agreement to be executed by
