Railroad Track Removal CO""'L'O^"O~'^L'"' I I I ORDINANCE NUMBER 8576 (Published in The Sal ina Journal ~ ~1 , 1977) AN ORDINANCE PROVIDING FOR THE REMOVAL OF ABANDONED RAILROAD TRACKS FROM THE CITY STREET RIGHT-OF-WAY; HOWEVER RETAINING THE RIGHTS OF THE CHICAGO, ROCK ISLAND AND PACIFIC RAILROAD COMPANY, UNION PACIFIC RAILROAD COMPANY, MISSOURI PACIFIC RAILROAD COMPANY, AND THE ATCHISON, TOPEKA AND SANTA FE RAILROAD COMPANY, I N REGARD TO THE FUTURE USE OF SUCH CROSS I NGS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Sect ion 1. That the Chicago, Rock Island and Pacific Railroad Company, Union Pacific Railroad Company, Missouri Pacific Railroad Company, and/or the Atchison, Topeka and Santa Fe Railroad Company, their successors and assigns shall remove all trackage from the city street right-of-ways not essential to their present operation. Sec t i on 2. That the railroad company removing such trackage shall retain the right to relay trackage and re-open such crossings at any future time they deem such trackage essential to their operation. Section 3. That when such trackage is removed from the paved portion of a city street, the City, at its own expense, shall repair, pave and maintain that portion of the street vacated by the railroad trackage. Section 4. In the event that any of the above named railroad companies re-open a street crossing under Section 2 of this ordinance; it shall also be bound to all conditions set forth in Ordinance Number 601 of the City of Salina. Sec t i on 5. This ordinance shall take effect and be in force from and after its publication in The Salina Journal, the official newspaper of the City of Salina.
