Second reading Ordinance No. 08-10446 amending Chapter 42, Article VI, Division 14 Sections 42-
302 and 42-303 of the Salina Code pertaining to permitted and conditional uses in the C-4 District.
BACKGROUND:
On May 5,2008 the City Commission approved a text amendment pertaining to the list of permitted
uses (Section 42-302) and conditional uses (Section 42-303) in the C-4 (Central Business District) on
first reading. The Commission approved two amendments to the draft ordinance which deleted mini-
warehouses, payday loan companies, tattoo parlors and massage parlors from the list of conditional
uses (approvable following review) and moved them to the category of prohibited uses. The attached
ordinance reflects these amendments and staff has added a Section 42-303.1 Prohibited uses which
clearly states the Commission's intent to prohibit those uses in the Central Business District rather
than just having them unlisted. This section could be added to in the future if other such uses get
identified.
Staff will be following up with some additions to the Definitions section of the Zoning Ordinance to
incorporate definitions of several of these uses, including the distinction between bars (conditional)
and restaurants (perm itted) use into the ordinance.
RECOMMENDED ACTION:
Adopt Ordinance No. 08-10446 as amended on second reading.
