Item
Vacation of a portion of the utility easement on the southeast 8 feet of the
northwest 21 feet of Lot 21, Block 8, iKey Acres Addition.
Background
Petition Number 4019 was filed on SePtember 20, 1991 by Donald and Shirley Roach
requesting the vacation of the northwest one half foot (1/2') of the existing
8-foot utility easement as shown on the attached sketch. The petitioner owns the
single family residence on this lot and discovered during the purchase of the
property in 1990 that the garage was built one half foot into the easement. The
easement was dedicated in December, 1976.
City staff has been working with Mr. and Mrs. Roach regarding this matter since
June, 1990. The scenario also involves an existing 4-inch water main located
approximately 3 feet from the wall Of the garage. The proposed solution is to
relocate the water main approximately 7 feet southeasterly. In order to do so, an
easement must be acquired from the adjacent property owner. The total estimated
cost of easement acquisition and waterline relocation is $2325. The petitioner
has consented to pay half of the total cost if the City will provide the other
half.
Recommendation
It is recommended that the City Commission approve the ordinance vacating the
northwest one half foot (1/2') of the existing 8-foot utility easement on Lot 21,
Block 8, Key Acres Addition on the condition that the waterline is relocated at a
cost to the property owner not to exceed $1,162.50.
