A resolution amending Resolution No. 07-6464 authorizing the construction of certain improvements
pursuant to K.S.A. 12-6a01 et seq.
BACKGROUND:
On December 6, 2007, Stan Byquist filed Petition 4303 for creation of an improvement district for
improvements to Quail Meadows Estates Phase IV. The City Commission adopted Resolution No.
07-6464 on December 17, 2007, approving the creation of an improvement district as described in
the petition. The petition and resolution contained references to the Quail Meadows Estates
Commercial Addition. This plat is in its preliminary stages; therefore, currently does not exist. Mr.
Byquist has signed an affidavit and waiver to waive his rights to challenge either the petition or
Resolution No. 07-6464 due to the incorrect legal description. The corrected legal description will
allow the City Clerk to record the amended resolution with the Register of Deeds as required by state
law.
FISCAL NOTE:
No change in fiscal impact will occur as a result of this action.
RECOMMENDED ACTION:
It is recommended that the City Commission approve Resolution No. 08-6495.
