Feasibility report for Petition Number 4002, filed by property owners in
Precinct 26, for the construction of a sidewalk on the north side of Ellsworth
Avenue from Ohio Street west to Roach Street.
Background
The petition accepted by the City Commission on January 7, 1991 has been
reviewed by staff and found to be valid under Kansas Statute 12-1803. This
statute allows "the governing body to, in its discretion, by resolution, order
such sidewalks constructed regardless of protests against such sidewalks."
The attached sketch illustrates the location of the proposed sidewalk. It is
proposed that two blocks of sidewalk be constructed from Ohio Street to Roach
Street. The current City policy requires that the adjacent property owners
bear 100% of the cost for sidewalks constructed on their property and that the
City absorb the cost for handicap-accessible ramps at the intersection of the
sidewalks with any streets. Eighteen private properties are affected by this
proposal at an average cost of $460 for a total of $8,330. The City's share,
on the other hand, is $11,645 or 58.2% of the total estimated cost of $19,975.

The property owners have the option of paying their share of the cost in a lump
sum payment or in installments over a period of four years.
The sidewalks are proposed to be standard "property-line" sidewalks to remain
consistent with the existing sidewalks and to save the cost of reconstructing
driveways. Handicap-accessible ramps are proposed to be constructed at each
intersection {on the north side) from Ohio to Huesner School. Every effort
will be made to prevent damage to trees and other landscaping. The City
Forester will provide guidance in this area.

It is recommended that the City Commission adopt a motion to accept the
engineering feasibility report for the construction of sidewalks on the north
side of Ellsworth Avenue from Ohio Street to Roach Street and direct staff to
prepare a resolution ordering the public improvement for consideration on
January 28, 1991. (The practical effect of defeating such a motion is to deny
the request for sidewalks.)

SCOPE OF WORK
This project involves the construction of public concrete sidewalks on
Ellsworth Avenue from Ohio Street to Norton Street.
ADOPTION OF ASSESSMENT
The assessment with accrued interest to be levied as a special
assessment tax upon the property included within the benefit district
concurrent with the general property tax and shall be in four (4) equal
annual installments.
The method of assessment shall be based on the square footage of
- sidewalk actually constructed.
- APPORTIONMENT OF COST
Cost Chargeable to Private Property
100% of the total cost of a four (4) or five (5) foot wide
concrete sidewalk and any incidentals thereto to complete the
sidewalk improvement.
Cost Chargeable to City
100% of the total cost of sidewalks located at street
intersections, sidewalk ramps, driveway reconstruction, drainage
pipe extensions, etc.
