A resolution declaring the necessity of and authorizing a survey and description of the interests in real
estate to be condemned for the purpose of construction of the South Ohio Street Corridor Improvement Project
Number 98-1138.
Background:
The South Ohio Street Corridor Improvement Project requires the acquisition of right-of-way, permanent
easement, and temporary construction easements, affecting 49 separate tracts of real estate. The acquisition
process is progressing well, however, project schedules require completion of the preliminary steps to enable the
City to exercise its eminent domain authority, should that be necessary.
The proposed resolution declares the necessity of acquiring the interests in real estate and directs the City
Engineer to make a survey and description of those interests. Should it be necessary to proceed with the eminent
domain process, the next step will be consideration of an ordinance authorizing the filing of a petition in the Saline
County District Court which commences the administrative proceeding whereby the interests in real estate can
be acquired and reasonable compensation determined by a panel of three court appointed appraisers.
