Background An agreement between the City of Salina and Bucher, Willis & Ratliff (BWR), dated September g, 1991, outlined the scope of the services to be performed by BWR to accomplish certain professional engineering services related to field surveys and photogrammetry for the entire East Dry Creek Interceptor project and the design of the gravity sewer phase of this project. The above.field surveys, photogrammetry, and design of the gravity sewers has been completed by BWR. It was, however, necessary in several incidents to authorize BWR to modify the preliminary alignment of the interceptor sewer at various locations; to provide additional time for meetings with affected property owners, consultants, our staff to discuss alignment options; to prepare additional legal descriptions and drawings of permanent/temporary easements; etc. We have reviewed the actual salary and overhead costs as shown on BWR's accounting records. The records show an additional $17,477.74 was incurred to provide these modified services. Recommendation It is recommended the City Commission approve the attached Addendum to Agreement for Engineering Services. This addendum increases the total maximum compensation for actual salary, overhead, and other direct project costs incurred by BWR in providing the required engineering services for the field surveys, photogrammetry, and gravity sewer design from $177,000.00 to $194,477.74. Attachment: Resolution Number 92-4526 COMMISSION ACTION MOTION BY SECOND BY This Addendum dated to the Agreement for Engineering Services dated September 9, 1991, by the City of Salina, Kansas, party of the first part, hereinafter referred to as the "City", and the firm of Bucher, Willis & Ratliff, Consulting Engineers, Planners & Architects, with offices located in Salina, Kansas, party of the second part, hereinafter referred to as the "Consultant". WITNESSETH: That the Scope of Services included in the Agreement dated September 9, 1991, included all of the services that were anticipated at the time of preparation of the Agreement. A maximum fee. of $177,000 was established to perform those specified services. That additional time and cost was incurred due to changes in alignment that were beyond the control of the Consultant. A detailed explanation of these costs has previously been provided to the City. That the City authorized Bucher, Willis & Ratliff to perform the additional services as described herein. NOW, THEREFORE, in consideration of these premises and the mutual covenants herein contained, the Parties hereto agree to amend the original agreement as follows: ARTICLE Z The City shall compensate the Consultant for performance of the services described in the previous section as follows: The sum of the following amounts: Actual salary costs, overhead costs and other direct project costs as shown on the Consultant's accounting records. No increase shall be made to the previously agreed upon fixed fee. o The total billing for Design Phase Services shall not exceed One Hundred Ninety-Four Thousand Four Hundred Seventy-Seven Dollars and Seventy-Four Cents. ($194,477.74) 1 Ail other provisions of the original agreement dated September 9, 1991 shall remain in effect. IN WITNESS WHEREOF, said parties have caused this Addendum to Agreement for Engineering Services to be signed by their duly authorized officers in three counterparts, each of which shall be deemed an original, on the day and year first written.
