Background The attached agreements have been negotiated with the railroad companies over the past several months for' replacement of ten (10) and removal of four (4) existing crossings on North Ninth Street between Bishop Street and North Street. The wood plank crossings will be replaced with concrete panels similar to those used on Fourth Street and those on West Crawford Avenue. This project is a continuation of the City's annual program of railroad crossing replacements. With the completion of the Ninth Street crossings, Santa Fe will be the only major railroad crossing corridor that is yet to be improved. The Santa Fe crossings are scheduled for attention in 1994. The costs of crossing materials will be paid by the City while the labor and equipment will be provided by each railroad company. It is anticipated that the project will take approximately 10 days and will require the detour of traffic. Recommendation It is recommended that the City Commission approve the attached agreement. Attachments: Resolution 92-4418 Resolution 92-4419 COMMISSION ACTION MOTION BY SECOND BY TO: AGREEMENT FOR THE INSTALLATION ' OF CONCRETE RAILROAD CROSSING MATERIAL ON NINTH STREET SALINA, KANSAS This is to provide our letter of agreement wherein The Atchison, Topeka and Santa Fe Railway Company will install at the Ninth Street crossing, full depth concrete railroad crossing material on four (4) tracks, to be furnished by the City of Salina. We agree that the existing crossing surfaces are to be removed and new surfacing to be installed to a length of 60-feet each on the four tracks. To accomplish this work and installation, the City and The Atchison, Topeka and Santa Fe Railway Company agree as follows: 1. The work will be performed at its expense by The Atchison, Topeka and Santa Fe Railway Company forces. Said work will consist of the installation of the full depth concrete railroad crossing surface material at the crossing as shown on the plans. All track material pertinent to this installation shall be furnished by The Atchison, Topeka and Santa Fe Railway Company. 2. The City of Salina will supply the material at no cost to The Atchison, Topeka and Santa Fe Railway Company; however, the material must be approved by the Railway Company before City places its order. 3. The Atchison, Topeka and Santa Fe Railway Company will notify the City Engineer's Office in advance of the date that work on the project is to be started and will coordinate this work with the Union Pacific Railroad Company, who will also be installing crossing surfaces, so as to minimize street closures. 4. The Atchison, Topeka and Santa Fe Railway Company, at its own cost and expense, will maintain the crossing surface in a manner satisfactory to the City and will make ample provisions for such maintenance, provided, however, that The Atchison, Topeka and Santa Fe Railway Company shall be entitled to receive any contribution toward the cost of such maintenance as may be now or tiereafter made available by reason of any law, ordinance, regulation, order, grant, or by other means or sources. 5. The City of Salina, at its own cost and expense, will provide all barricades, lights, flagmen or traffic control devices necessary for detouring vehicular traffic for complete closure at the crossing. 6. The City of Saiina further agrees to allow The Atchison, Topeka and Santa Fe Railway Company to drain the crossing area into existing City storm sewer manholes, if available. The drain pipes and filter fabric will be furnished and installed by the Railway Company. 7. The City will reconstruct or repair the road Surface approaches to the tracks and the street surface located between tracks to conform to the concrete surfaces. 8. At such time that the concrete crossing surface material must be replaced, replacement will be made by the Railway Company, using material mutually acceptable to both parties; however, this agreement does not commit the City of Salina to any future replacement or maintenance costs. 9. Both parties agree to the requirements of Title VI of the Civil Rights Act of 1964, which by reference is made a part of this agreement. The work proposed above is agreeable to The Atchison, Topeka and Santa Fe Railway Company under the terms and consideration stated herein. If this is satisfactory and agreeable to the City of Salina, please indicate concurrence in the space provided.
