8.5 Storm Water Committee Appointment CITY OF SALINA REQUEST FOR CITY COMMISSION ACTION DATE 8/27/2007 TIME 4:00 P.M. ITEM: Appointment of Stormwater Ordinance Ad Hoc Committee BACKGROUND: As you may already be aware, the Environmental Protection Agency has implemented a Storm Water Program which imposes additional requirements upon states and communities within each state based upon their classification as a Phase I or Phase II community. Phase I communities are defined as having a population of greater than 100,000 and Phase II communities are defined as having a population greater than 10,000 up to 100,000. As Phase II community, Salina's National Pollution Discharge Elimination System (NPDES) permit issued by the Kansas Department of Health and Environment provides that Salina shall: "enact such ordinances or resolutions to require erosion and sediment controls to ensure compliance, to the extent allowable under State and local law; and requirements for construction site owners or operators to implement appropriate erosion and sediment control best management practices; and requirements for construction site owners or operators to control waste such as discarded building materials, concrete truck washout, chemicals, litter, and sanitary waste at the construction site that are likely to cause adverse impacts to water quality; and procedures for site plan review which incorporates consideration of potential water quality impacts; and procedures for receipt and consideration of information submitted by the public; and procedures for site inspection and enforcement of control measures." City staff has utilized example ordinances suggested by KDHE to prepare a draft ordinance for consideration by the Planning Commission and ultimately by the City Commission. An initial public hearing was held before the Planning Commission and representatives of KDHE were in attendance to discuss implementation of the Phase II regulations. An additional public hearing was held before the Planning Commission on Tuesday, August 21st. Based upon the public input received at the most recent meeting, the Planning Commission voted to recommend to the City Commission that an Ad Hoc committee comprised of design professionals, contractors and 2 Planning Commission members be formed to review the requirements and proposed draft and provide input regarding a final recommendation. City staff have been in contact with likely committee members and forwarded those names to the Mayor for his consideration. CONFORMANCE WITH STRATEGIC PLAN: The proposed action is consistent with the following components of the City's shared vision statement: . Salina will be environmentally conscious, balancing the expectations of a growing community with the necessity to preserve nature's assets and our future quality of life. The proposed action is also consistent with the following goals contained in the City's strategic plan: Goal #4: The city will maintain growth and development policies that are updated to reflect current conditions and desired growth direction. Goal #5: The city will maintain a commitment to making downtown Salina a thriving and vibrant center of the community. FISCAL NOTE: No fiscal impact has been identified. RECOMMENDED ACTION: Names of individuals willing to serve on the proposed Ad Hoc committee have been provided to the Mayor for his consideration regarding a recommendation to the City Commission.
