Background The petition was submitted on May 25, 1993 by Mr. Bill Medina and other property owners in the Hansen Court Addition. This item was tabled at the June 21 meeting to allow the petitioner to negotiate further with KPL and Cable Television in regard to utility poles. The purpose of the request is to allow the construction of permanent buildings and other development of the existing easement area. The 35 feet of right-of-way for Michigan Avenue was dedicated in 1926 as part of Block 2, Hansen Court Addition. The entire 35 feet of right-of-way was vacated in 1961 with retention of a utility easement. In 1980 and 1982, two office buildings were constructed on the east side of the vacated street right-of-way. The franchise utility companies have reviewed the proposed vacation request. The only apparent conflicts involve three KPL power poles and one Cable Television pole located on approximately the centerline of the 35 foot easement. All other utilities are private service lines located on the east 17.5' foot easement. No City utilities exist in the vacated Michigan Avenue. The recommendation from the City franchise utilities is to allow the vacation of the west 15 feet of the existing easement. This would result in the retention of a 20-foot utillity easement in the vacated Michigan Avenue. RECOMMENDATION It is recommended that the City Commission approve the ordinance allowing vacation of the west 15 feet of the utility easement located on the west 17.5 feet of the vacated Michigan Avenue from the south line of Iron Avenue to the north line of Stapler Avenue on the condition that KPL and Cable Television .companies relocate the existing pole guy wires.
